- How quickly do they take you to Court ?

Hi, I'm a longtime member but newbie to chat forum. Sorry to start a new thread but i dont know where to find an answer to my dilemma.
Boyfriend just cancelled car insurance to which they sent a letter, dated 1.6.05, saying there was the present month due and their cancellation fee = £47 odds and this must be paid within 7 days of date of letter, or referring to a solicitor. Then a letter comes from the solicitor dated 10.6.05 saying if not paid in 7 days, again from date of letter, the case is going to court. We had been away visiting friends and "mum-in-law" forwarded mail to my house (100 miles away from her) so only arrived to me today 17.6.05. Boyfriend has to travel with work sometimes so she redirects mail to me to deal with) so I only opened mail when i got home from work after 6pm.

I tried to call the solicitors office but of course they were closed. I am absolutely horrified that things have gone this far so quickly!! The post getting upto the Highlands of Scotland is slow enough but with this in turn being sent to me would (and has) taken the week anyway.
As today was the 7th day and they were so prompt in taking things this far already, will they already have sent this case to Court? I will call them of course first thing Monday morning, but does anyone know if they would already gone that far, or would it be acceptable for me to insist they drop any proposed action and let me pay the due amount (which is shocking in itself, that there is a cancellation fee! - its their own fault policy was being cancelled anyway, as they wouldnt amend the policy to any driver!). Please could anyone oblige with me some advice or would we have to take it to a solicitors also ??? :question: :mad: :confused: Thanks for any help.

    Suspect that if you phone the solicitors on Monday and confirm that a cheque will be sent immediately, they will hold off from taking the matter any further. If they have already filed proceedings with the court, they will no doubt discontinue once the money arrives.

    This all seems incredibly heavy-handed for the sake of a £45 cancellation fee!!:eek:

    I'm sure that you won't be using this insurer again! Out of interest, which insurer is it?
  • thanks. and you are quite correct - they had not started the proceedings. It was through the online insurers Its4me. I tell you, what a weight of my mind - all that worry, as you say for £40 +.
