Another Excel parking thread, sorry...

Hi

I'm posting this as I couldn't find an answer to a specific question in the Newbie section. I will try and keep the facts brief initially. Wife parked at Excel Smyth Street car park in Wakefield and paid for a 24 hour ticket on 18/4/2024. Car is a lease car through NHS fleet solutions. They forwarded a PCN. Confident that she hadn't done anything wrong the wife appealed the PCN by including receipt. Got a rejection today stating she arrived at 07:09 but didn't pay for ticket until 07:28. They have been quick to point out she has admitted being the driver. Reading the threads I struggled to find how much of a difference this makes. I've picked up that the Excel/VCS combo introduces ambiguity to the contract. Any initial thoughts on the best line of defence?

    Ignore them unless she gets a court claim.

    Nothing to worry about. But there is no appeal so certainly don't do anything more. Unless she moves house, but that goes without saying because she needs to see the letters.

    No paying and no trying the farce of IAS.

    Thanks for the quick reply. Would it be wise to send a letter/email to the lease company advising not to deal with them?

    It has been known before for lease companies to pay the "charge" and then pursue the hiree.

    Couldn't hurt. Make sure they don't disclose any personal details either.
