I have had a decision from the Ombudsman and apparently smart meters can acceptably be out by up to 2 hours, so although I used the electricity at off-peak times, it is apparently right that I was charged peak rates. It is apparently up to the end user to correlate meter times (note the visible time on my meter is correct) with usage.
