It will come down to the contract, so you really do need to get hold of a copy. This is a business transaction, so you have no statutory consumer rights or cooling off period, everything is determined by the contractual terms.leighross said:Very Small Business (Do a craft fair once in a while)
Searched google for a card machine and having to put phone numbers in for someone to get a hold and go through things.
Pete from The Red Wood Group Company calls and says we are doing an offer for the machine and its £1 per month for 12months - Excellent or so I thought
I asked a few times what else do I have to pay per month? He kept replying just £1 per month
So I go ahead and agree to join, get the terminal and set it up ect (had to make a payment)
Then WorldPay sends a letter out, in this letter I owe £32
I ring up worldpay and ask what is this for I haven't even used it yet.
They explain a £15 fee for not using the machine or under the stated amount each month, and £15 fee for the terminal.
I then ring up The Red Group Company and "they look into it"
I have an email to state yes they have in fact put me on the wrong "offer" of £1 per month for terminal instead of £15 per month which is half price (WorldPay said that ended last year)
I'm wanting to cancel the contract as Pete has stated I earn loads a year plus didn't say anything about not using it and would be issued a £15 fee for each month. (Plus I don't make in sales as much as what he stated)
I couldn't access the contract as in the email they sent over didn't work, I'm not in the cooling off period. The Red Wood Group have just done so many errors. I personally want to cancel the 12 months contract
I have sent over an email after they accepted the fact they didn't put me on the right offer, I replied with I want to make a complaint. I explained to Pete the circumstances and no where told any information about charges. Also are calls recorded? Any help much appreciated
Do you have access to a business legal helpline or similar?0 -
B2B contract.
So no consumer rights.
Retailers do not have to have a complaints process,
You will have to get a copy of the T/C & see exactly what they say about cancelation.
A easy way to get round no use, is to use your card to meet the minimum amount.Life in the slow lane0 -
Do you effectively have two separate contracts here, i.e. one with Red Group for terminal rental and one with Worldpay for payment processing services, or are those bundled together somehow?leighross said:Pete from The Red Wood Group Company calls and says we are doing an offer for the machine and its £1 per month for 12months - Excellent or so I thought

What actually happens when you try to open the emailed document(s)?0 -
Bundled together, and the email of the contract was passworded which I didn't have the password for.eskbanker said:

You could have walked into any number of stores and bought a card reader for about £20 so why the initial difficulty in getting one?1
-
I was wondering this as well. I've just searched Google for 'card machine for small business' and as expected, the main players are all there. I've scrolled through the first couple of pages and The Red Wood Group are nowhere to be found, they appear to be a small niche telecom business.CouldntResist said:You could have walked into any number of stores and bought a card reader for about £20 so why the initial difficulty in getting one?
A Sumup card reader is less than £30, no monthly fees and less than 2% transaction fee when used.
You frequently see them at craft fairs and most outdoor events - why look anywhere else?0 -
Sumup, Zettle (formally iZettle) and Square are all very common sights in all forms of markets and fairs. All low cost devices, free software and no monthly fees or minimum transactions. All have personalised rates if over £250,000 turnover per year or such but assuming OP is no where near them.[Deleted User] said:A Sumup card reader is less than £30, no monthly fees and less than 2% transaction fee when used.

Can only assume the OP searched during a period where the company was running AdWords campaign so they saw the advertisement at the top of the search engine results.
As others have said, consumer are considered vulnerable to exploitation by big business hence have lost of nanny state style statutory protections. As soon as you are a business, no matter how small, you are considered to be in big boy pants now and able to look after yourself. As such it comes down to the terms you agreed rather than the law giving you a cooling off period.
It's unclear what is happening with the one part where you do appear to have a legitimate complaint on the machine rental of the £1 offered -v- the £15 charged.0 -
I would have liked to see some helpful replies. But on here its a battle, I have called and they are looking into my contract will await and see what happens.0
