Mis-sold Car

Hi, I bought a used car from a large well knows company,on 5th April, took it for a service on the 17th April,was advised by the garage that the car was not fit for purpose and a main problem with the car was the head gasket had failed. Was told not to drive the car as would cause more damage. I immediately contacted the company I bought it from…1 week later, each time I contact the company, keep being told they are reviewing the case…what are my rights? Can I ask for a full refund as it’s been less than 30 days… any advise will be greatly appreciated. Please help x

Yes, you have the short term right to reject within the first 30 days:

first question is did you take it to one of the suppliers recommended garages or in house garage. Rightly or wrongly if you went independent they will object to an outside opinion saying not fit for purpose. If possible get the car recovered by them or your manufacturers recovery service and dump the car back into the garage you bought it from
Keep the pressure on a lot of sales managers in the trade will try to ignore things like this for as long as possible. Big groups have a lot of pressure to keep costs down as expensive mistakes affect profit related bonus’ etc. Don’t be afraid to escalate it up the chain to get resolved.
Finally you say you bought it from a well known company check what warranty they gave you on purchase they should of at least offered to fix it for you by now.1 -
It seems rather strange that a vehicle from a "large well known company" would be sold without it being serviced if that was due imminently.
How old is the vehicle and has it been serviced in accordance with the manufacturer's schedule?2 -

Unfortunately issues with cars from 'large, well known companies' are not uncommon. Our neighbours bought a Ford Kuga from one and it overheated on the second day they had it. They had only driven it 2 miles home on the day of purchase so the problem wasn't immediately apparent. They took it back and the sales guy dismissed the problem as somebody forgetting to refill the coolant when it was serviced. That's a red flag to me in that they were apparently so blase about that anyway. The coolant was filled up and the next day the same thing happened again. My neighbour took the car back and insisted on a full refund as their old car was apparently no longer on site. The dealership finally gave in, but not without a battle.

Thanks for the advise, I bought it from big motoring world, they did not advise that a service was due, nor did I ask… but that’s just myself not knowing to ask…feel really stupid for not asking basic question, and put my trust in the company to sell me a car that is fit to drive. However I’m glad the service light came up now and not months down the line. Car came with a 90 day warranty. The response from the company has been really slow and drawn out. I have now exercised my right to reject the car within 30 days of purchase. This has now been passed onto another team… so let’s see what they offer now. They have not offered to look at the car, I have sent the report to them from the garage. They have the worst after sales team.0
