Debit Card Section 75 on Car Purchase

Hi

I purchased a van in 2021 and just over 6 months later it developed an electrical fault. I emailed the dealer and they advised me that the warranty they supplied didn’t cover electrical faults.

Fast forward a couple of years (spent trying to fix it) and I’m at the point of scrapping the van. It was purchased on a Visa Debit card and I have a copy of the email telling them about the problem soon after purchase. I’m now wondering if I’m covered by Section 75 or anything else.

Does anyone have any advice on this?

    There is no section 75 protection when using a debit card.

    ^ Yep. S75 is Credit facilities only..

    & way out of time for chargeback.

    You have rights against the seller if the van has a significant electrical fault and you have evidence that the fault was present when you bought it (even if the fault did not become apparent for several months).

    You would need to get a proper diagnosis done to show (1) there is a significant electrical fault and (2) it was present when you bought the van back in 2021.
    You could then ask the trader to repair or give a partial refund. If they are unhelpful or are no longer trading and you paid some of the purchase price with a credit card or on finance, you could register a dispute with the financer because they would be equally liable. That would be a section 75.

    Lots of 'if's. The first step would be to get that diagnosis.

    It was on a Debit card and whilst there was a fault soon after purchase, and I told them about it, I've only just got a professional diagnosis.

    I guess the moral of the story is get a diagnosis asap and don't get fobbed off!
