Probate, inheritance and undiagnosed vulnerable adult

My dad died recently. Myself, and two siblings are the executors. We are sorting out bank accounts and house valuation. One of my siblings is a vulnerable adult but he doesn't have a diagnosis. He won't talk to doctors. He does not receive any disability benefits. There's obviously a health condition but he ignores out attempts to help. He has one child but no partner.

He is useless with money and will spend it on anything quickly. My question is can we protect him easily? A trust appears to be out of the question as he does not receive disability benefits and refuses help with the forms. I also can't be reponsible for him as I have a special needs child and no one lives near him. There's nothing specific in the will.

  • Sorry for your loss. I'm not qualified but have been through something similar and even with a diagnosis, there was nothing we could do as the will did not set up or state otherwise. The money had to go directly to the vulnerable adult as per the will.

    I am afraid you will just have to give him his inheritance and let him get on with it.

    Not only can you not protect him easily, unless he's prepared to co-operate in having his share put into trust (seems wildly unlikely), you can't protect him against himself at all. Frustrating and sad, but that is the unhappy reality.
    Googling on your question might have been both quicker and easier, if you're only after simple facts rather than opinions!

    Could you find a way to discuss savings accounts where the capital is locked away, but the interest is paid monthly.  I have these with my inheritance from my Mum.  He may need help at the maturity date to move to similar accounts.
