Speeding

Got a speeding letter and admitted I was guilty . I was said to be doing 35 in a 30 zone. N Yorks police letter says they give leeway of
 30 plus 10% plus 2 so 35.
But they start prosecuting at 35 shouldn't this be 36 ?? 
56 years of faultless driving 2ithout a fault so I am cross with myself 
make the most of it, we are only here for the weekend.
and we will never, ever return.

    You are deemed to be speeding at that, so you get a ticket but not at 34 mph.
    You'd also get a ticket at 46 in a 40 but not at 45 mph.

    I realise they tell me I am speeding but the figures dispute that....

    10%+2 means that 35mph if the lowest speed at which they'll take action, not the highest you will get away with. 

    If you want to think harder about it than you probably should, measured speeds are always rounded down rather than up, so your actual speed was probably something like 35.5mph, which is over the 10%+2 threshold by a whole 0.5mph...

    I very much doubt whether the letter actually says they "give leeway".

    The NPCC guidelines, with which all forces comply, state that 10% plus 2mph is the starting point for action. So if you want to think if it in terms of a leeway, that is 10% plus ONE.

    Note that they also say "these guidelines do not and can not replace a police officer's discretion.".

    Finally, the police guidelines do not apply to the courts, so if you were to be prosecuted they do not give you any defence. And the magistrates own sentencing guidelines start at 1 mph over the limit!

    you were going in excess of 30 -- so you were speeding

    Enforcement STARTS at 10%+2 -- you were bang on the limit for the start of enforcement

    Yes it sucks - but if you’ve only been caught the once In  56 years, then you’ve done well. (I guarantee you’ve broken the limit way more than once)

    Remember also that the speedo always overreads the actual speed to prevent you unintentionally breaking the law - so if they caught you at 35 your speedo was almost certainly showing 36-38mph - did you think you were in a 40 limit and thus driving under?

    Depends on the tyre sizes too if different from manufacturer spec. Some sizes will read below or above actual speed.
