NEITHER, not at this point in time

You may need to do so before you get to the WS stage, but you are not there yet

If getting a SAR was the current forum thinking it would be in the NEWBIES FAQS thread.  It isn't.  Do not get a SAR.

    Hi,

I emailed dcb legal the template letter and received this response:

We write in response to your email dated 01/08/2024,

We note that you dispute the Parking Charge Notice (PCN) and have requested a thirty-day hold.

Please note, when parking on private land, the contractual terms of the site are set out on the signs. You are entering a contract and agreeing to the terms by parking and staying on the site. Parking in breach of the terms as stipulated on the signage means that you are then breaking the terms of the contract. The signs would also stipulate additional recovery fees would be added for non-payment of the PCN.

The HMRC ‘VAT Supply and Consideration manual’ (VATSC06140), which was last updated on 02 September 2020, confirmed that parking charge notices falls out of the scope of VAT.

Your request for a thirty-day hold will be placed on the file until 01/09/2024.

Following this date, you will be required to pay the outstanding balance of £160.00. Failure to do so will result in a claim being issued against you without further notice.

     Kind Regards,

    Litigation Support Associate

Report them to HMRC for suspected VAT fraud, possibly in the £millions.

Takes less than 5 minutes to do online.

Please search the forum for the obvious keyword!   This is how the forum works best and saves us repeating stuff on every thread.

    The obvious keyword?

Hi, yes I will do that. Is there anything else I need to do or do I just wait for a claim form now?

Absolutely not. No paperwork is used.

Please re-read the second post of the NEWBIES thread now.  This is easy. See my signature for how to click back there.

In the NEWBIES thread you are literally walked through acknowledging the claim with pictures of every page online.

And show us the front page (the Claim form) covering up your data, the QR Code, your VRM, the Claim no. and the MCOL Password.

I actually followed the signs which stated 2 hours free parking and charges apply for all vehicles after 2 hours on one sign. Also the restaurant I was visiting had signs up saying 2 hours free parking and a fee is payable after 2 hours. I have noticed another sign that also says up to 2 hours free and in very small writing you are not required to pay when parking for less than 2 hours. I actually paid.
