ANOTHER ONE BITES THE DUST
Hi, I had my hearing with Total Car Parks, they sent a solicitor not from DBC Legal but DCB Legal sent someone out. I was really nervous and was thinking about just paying up. Glad I didn't.
Signed in at the court and the solicitor for claimant came over said hi and and stated where the claimant stood on the matters " paid less than the tariff displayed and car park contract" and said they would accept £385 settlement. I said, no thanks.My issue was that I had paid for parking just after my free 2hours and not when I entered the car park. We were called in to the hearing room after a very long wait. Hearing at 10 in at 2pm. Judge introduced himself and went though what he thought was the main issue. He said the main point was, did I stick to the contact of the car park.
He dismissed it because:
The photos of the signs the claimant supplied were very clear on printed paper under office lighting. I pointed out that the PDF artwork was not a true representation of the actual signs in car park. I went back to the car park and took actual photos of the signs. Which he agreed were not clear as the ones the claimant supplied. The signs where also unclear, one stating 2 hours free parking in bold lettering and the other sign in much smaller font saying you must enter your car reg when you enter the car park. The fact that the signs were not clear and meant that I could not have had a contract under the Consumer Rights Act. It was obvious to all that I was not trying to evade the fee I simply followed the instructions on the signs.
I think the short fall was about £1 had I put in my actual entry time which I said was disproportional and over inflated. The judge agreed and was unsure why it got this far. He awarded my travel, car parking and £95 which I believe is the most they award for loss of earnings.
The more I read through the claimants witness statement the more I just thought what chancers they are and what a joke the whole thing was. Although I haven't actually been laughing. Thank you everyone, @Coupon-mad for all your help and guidance I really would not have been able to do this without this platform. For others, don't give up and don't doubt yourself. Thank you.
