    I have now received a Letter Before Action from Civil Enforcement. Claiming £170. Details of the PCN, date, amount, site, vehicle reg.

    I have posted a letter of complaint to the landowner, a now single director (previously wife and husband) company clearly set up specifically for this car park. Highlighted they are vicariously liable for breach of the Equality Act 2010. And asks immediate cancellation of the charge to avoid progressing further. I got the contact information via the "evidence" pack provided in the POPLA appeal - I think, it's been a while.

    On the LBA, there is not actually any postal address or email address for me to send my response to, except for small print at the very bottom "Horton House, Exchange Flags, Liverpool L2 3PF". Should I send a letter there? Or is there an email address I can use for Civil Enforcement?

    Just noticed, although the letter was received yesterday in the post (23rd April), the date on the letter was 15th April… sneaky tactic no doubt. I don't suppose that matters too much, I've replied now via the 3 email addresses I could find for CEL and then used the data protection one to make a SAR.

    So I wrote to the landowner and received a response today denying any connection to the PCN, CEL or the car park (Leen Gate Convenience) at all.

    "LGCP ltd have no contract or jurisdiction either with or over "CEL" "

    They also claim they do not operate or own a car park "Leen Gate Convenience".

    Through POPLA I was provided a confirmation of appointment. It clearly listed the two directors (husband and wife) and LGCP ltd. I checked in company house before sending the letter, and it all matched up, just the wife is no longer a director. The address was their accountants'.

    Seems like something fishy is going on here?

    I've had no response from any of the emails to CEL, where I acknowledged receipt, denied liability and an SAR to their data officer email address.

    I'd reply to the landowner attaching that and asking if Creative Car Parks (aka Civil Enforcement Ltd) falsified it then?!
