CCJ enforcement time

Options
Hi Everyone,

What's the time frame after a parking offence that a private company has before they can issue a CCJ.

For example if you parked somewhere in January, is there a specific time frame that they have to serve the CCJ or can it be whenever they like?

Just wondering, thanks!

They can apply to the courts up to 6 years after the alleged "debt" was incurred.

They can start a claim within 6 years of the 'cause of action'. This period can be extended if you acknowledge a debt by payment or in writing.

They can enforce a ccj within 6 years of judgement
  • Thanks! My partner had a private parking ticket in early 2017, but he'd sold his car and moved house. CCJ wasn't issued til late 2018 so we were just curious. He paid it years ago so it's satisfied, weren't sure if it could be moved back if they had to issue it within a certain time frame. 😃

They issued the claim within 6 years. He paid it.

If he did this within one month of judgement it should not appear on his credit file.

Otherwise it drops off in late2024

He paid a private parking charge (the extortionate amount of around £200-£300 after a court claim) even though the claim went to an old address?

That CCJ was able to be set aside (wiped entirely) and the claim dismissed due to the use of an old address.  There was no need to pay it or suffer a satisfied CCJ on his record.

I hope there is never a next time but - all the time the rogue parking industry continues to duck the long overdue DLUHC regulation - don't pay private parking charges.

Not even if discovering a CCJ.

Come to the parking tickets board if you get any invoices, debt threatograms, court claims or CCJs relating to a private parking charge.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I wish I'd have seen this response sooner. I've gone on Google maps and noticed in 2017 the signage was in a different place to 2018. Meaning in 2018 the signage was visible upon entry to the car park. And not in 2017

We only have about 30 days now til we have to move so unfortunately it is probably too late to get the ccjs removed
