Oak Tree on Purchase Property. NIGHTMARE!

Haha. We've come across this in our relentless search for the unanswerable question. As you say, it's an extremely complex, legal matter that is by no means black and white.
Unfortunately for us, the developer has doubled down with their stance on the tree. They've informed us today that they'll withdraw from the sale unless we inherit liability, although they'll still honour the cost of felling in the future.
We've requested all documentation and correspondence regarding the tree matter and will make an informed decision from this.
I'm the interim, we've decided to continue with the sale of our current property. We went to market March last year and can't go through the stress of the selling process again. We're lucky enough to have family close by to easily house us whilst we decide on what we're going to do. Hopefully the market won't skyrocket. We bought in 2011 so are fortunate enough to have gain a substantial amount of equity in that time.
Moving out now will put us in a good buying position if we do decide to find another property.
