Civil enforcement Ltd - do I have a chance with no evidence?

Hi there,

Im on holiday and I received a message saying I got a PCN through the door... My mum opened it and wow!

There was a festival on this day where I was told blue badge parking would be at the site.

I asked if I needed to pay, replied nope, just need to pay the ticket price and carry on with my day. This was from a staff member or volunteer for fort Amherst.

So imagine my shock when I got this through the post...

With the eight hour time difference I rang up Fort Amherst to make a complaint like the newbie post said, and to my surprise they were putting all the blame on me...

"There were staff at the gate telling you to go into the cafe and pay parking"

No, there wasn't. But I don't have any proof.

"it must've been a volunteer that told you"

I don't know, I don't have proof. But surely you should train your volunteers to say that I need to pay for parking??

0 information about paying for parking for this event, just "blue badge only parking at the site"

And reading some Google reviews I'm not the only one that has been caught out with a parking fine.... Well I'm never going here again!!

My question is, I will appeal, but this is a he said she said situation now. With no evidence on my side. Is the chances of this being rejected at the Civil Enforcement Ltd appeal stage high, and then higher at Popla? I can't really afford a higher fine than this and it's put a dampener on my holiday since the fourteen days expires whilst I'm flying home...

    Welcome.

You say "I rang up Fort Amherst to make a complaint like the newbie post said".
Where exactly in the NEWBIES thread does it say anything about ringing anybody?

I know that's my bad on that part. I am also dyslexic and ill so I could have entirely misread.
  • Is there a way to edit or delete a thread? Now realising image didn't blur out everything.

I can't see anything harmful in that image, but if you really want it deleted then hit the 'Report button below your post and ask MSE's Forum Team to deal with it. The Forum Team only work 9 - 5 (or thereabouts).

No it's OK. The image can stay, but we didn't need to see it.

Nothing new there.  This isn't a PCN nor a fine.  There is no "wow" about an invoice from this bunch.

    Read the NEWBIES thread.
PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Okay thank you, i have been looking at an email to file a complaint in to fort Amherst. They are seemingly impossible to get into contact with aside from phoning. Only place I have to write something up is their contact us section, which I guess will have to suffice. I am not expecting a miracle if their phone manners are anything to go by. How dare they offer blue badge parking then make the blue badge user have to go into a relatively crowded place at the time to then input their information in a non accessible manner. And that's if they were told the correct information in the first place! It's almost like they don't want any customers lol.

Assuming they don't write to civil enforcement to cancel this ticket, i have until 8th may to make an appeal. Then it's off to popla! Atleast I can try to enjoy the rest of my holiday and deal with this mess when I get back home.

From just looking the front of the NtK, it is not PoFA compliant, unless there is additional info on the back. PoFA 9(2)(e)(i) is not complied with. However, that may be a moot point if you have revealed yourself to be the driver when you contacted CE.

I have not contacted CE yet nor revealed to them who the driver was. At the back of the document is no more revealing information that would make them compliant to what you're referring to. Ironically it's the "how we handle your data" spiel.

That's certainly not the only thing on the back of a CEL NTK but we don't need to see pics because there are already CEL NTK images in the NTK pictures thread that I started (linked in the NEWBIES thread, or click on my profile).
