Hi I purchased a dishwasher from currys August 23 and its had numerous intermittent faults then it developed a major fault 4 weeks ago so booked in with a engineer because its under warranty. Took the day off work and the company rang me an hour after engineer was supposed to be arriving and said he was sick and rescheduled another appointment for this week. So I took another day off and this time the engineer just didn't arrive so I rang the company and they said that the appointment window was only a estimate and to wait until 6pm as they couldn't get hold of him . Anyway he never turned up. I'm self employed and lost 2 days pay . I rang currys and asked for a refund as I'd given candy the manufacturer 2 chances to repair and they failed . Currys are refusing a refund as I've owned the dishwasher over 30 days . I'm at a loss can't afford another day's loss of earnings and my dishwasher won't work. I've hundreds of messages about consumer rights but I'm getting ignored. What's the next route can anyone help please

The retailer has the one attempt to repair before you can then reject the goods but it sounds like you jumped straight to the manufacturer therefore not giving them their opportunity.
I've not seen any court cases on the matter but I am not convinced that the courts would see an engineer being a no show count as a repair attempt.0 -
I was passed on to the manufacturer right away I wasn't given a option0

I agree that a no show is not the same as a repair attempt, but you imply that there has to be a repair attempt before the consumer can reject for a refund. That's not quite what the law says.DullGreyGuy said:The retailer has the one attempt to repair before you can then reject the goods but it sounds like you jumped straight to the manufacturer therefore not giving them their opportunity.

That is what is said in section s24(5)(a), but section s24(5)(c) says that the consumer can also reject if the engineer is a no show if he does not attend 'within a reasonable time and without significant inconvenience to the consumer.'
I agree that the OP would have jumped the gun in terms of 'reasonable time' even if he had pursued his claim with Currys, as he should have done.

I did originally ring currys but they passed me right onto candy for the repair?? I just assumed I was following the correct procedure0

Don't worry, it's fine for a retailer to use the manufacturer as their agent. But you must deal with Currys. You should be complaining to them that their agent has had two opportunities to inspect the machine so you either want the machine repaired/replaced or reimbursement of the costs of the extra visits (if you've actually lost money)mitchgee said:I did originally ring currys but they passed me right onto candy for the repair??
