Hello everyone,
thanks in advance for any help I receive here.
I may be a little late in seeking advice but here goes…
so I was issued with a parking fine for parking out of hours for 10 minutes in a retail park by UKPC March 2023.
i refused to pay the fine & disputed the claim online via their website as I had a flat tyre on a dual carriageway & this was the immediate turning available so parked up & changed my tyre. UKPC responded & asked for evidence of my recovery invoice, to which I responded I cannot provide evidence of this as I swapped my flat with my spare tyre… I have a trolley jack & tools in my boot as I work on cars a lot.
i Have now received a claim form from DCB legal asking for £268.60 to which I have responded a defence already, stating the facts I have written above.
DCB legal have emailed me privately asking for a “reduced fee” of £100 to settle this claim out of court. I have 7 days to take up this offer but I feel that I’d rather risk the court making a decision!
about the car park:
there are the usual signs displayed on posts with tiny writing explaining the terms of parking, including that there is no parking out of hours.
there is a barrier at the entrance of the car park which has a sign on it reading “this car park barrier will be locked out of hours” - which obviously, it was not.

The help you require is in the NEWBIE sticky, which all posters are urged to read BEFORE posting. If you have already submitted a defence to the CNBC, have you received confirmation that is was received, have you received your N180 (DQ) form yet? Continue with the process as outlined in the 12-steps in the template defence thread and you will feature in this thread: -

Cover names and full email addresses but don't just copy & paste words. I need a screenshot to show it's genuinely from DCB Legal.

I was particularly interested as the settlement is £100 which shows that DRAs can work with merely demanding the PCN sum (then splitting the monies in cases where people pay). And this is AFTER they've shelled out £35 to file a claim.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

You MUST tell the court and the legals if your address changes just in case the C ever pays to lift the stay.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
