  • No, the opposite will happen from this year.  Massive improvements will make court LESS likely.  And APCOA never sue so they won't start now, because:

I am on the Government Steering Group and regulation and a new Code of Practice is being finalised as we speak. This year.

Lots of good changes, including better practices, lower £PCNs and a likely ban on the added £70 that DRP are drooling for.

So, once the new rules are all in place, there will not only be far less likelihood of old (pre-statutory regulations) cases going to court - because Judges won't give the 'bad practice' old cases the time of day - but ALSO the new Code is bringing with it a proper ADR.

An ADR designed to keep cases out of court.  You could by the end of this year ask APCOA to allow you to appeal to the new DLUHC ADR.
Thanks for that. Do we have a date when this will happen? I saw there was new legislation but wasn't sure if it got through the house of lords?
It got through the House of Lords 5 years ago! The legislation is enacted & dated 2019.

page 27 onwards summarises the position:

    https://researchbriefings.files.parliament.uk/documents/CBP-8736/CBP-8736.pdf

Final Public Consultation & draft IA expected within weeks and the new Code then re-laid.

YOU HAVE NOTHING TO WORRY ABOUT.
Thanks a lot! Will take a look :)
  • like an effort that is too onerous, when in fact it takes less than a minute to compose an email and send it to the DPO of APCOA, and therefore, it is just easier for you to fund the scam. That sounds like a fool and their money to us.

What's easy for one may not be easy for another. Everyone has different time constraints and responsibilities. It's not the act of rectification that's a problem. It's the fact I may forget. Have you ever forgotten to do anything?

I'm more convinced that ignoring carries less risk (thanks Coupon-mad). Even if a risk is very unlikely (close to 0 by the sounds of it), it's still a risk. What's important is whether the risk of them actually pursuing court is greater than me forgetting.

  • But with that being said. I will ignore for now and hope that this new law comes to pass soon

I've already forgotten what I wrote. However, once bitten by the unregulated private parking scam, I never forget the important things such as updating my V5C if/when I move, checking the area and notices when I have no choice but to park on private land, make sure I set up at least 6 months of mail redirect when I do move to name a few things.

You could always set up a recurring reminder on your calendar every month or two to remind you that you need to do a data rectification notice to any PPC you have received a PCN from and have been ignoring.

These are just a few suggestions to assist you in dealing with these scammers. None of us, and I'm sure you too, do not want to fund these scammers. The work done here is but a drop in the ocean in attempting to get these unfair PCNs cancelled.

When you move, do you have a checklist for informing important institutions like your bank, DVLA (licence and V5C), Electoral Register, car insurance ...........  Just add the DPO of the PPC to your checklist!
