    Also, just noticed this;

    he Defendant acknowledges the VRM SJ59LHV (“the Vehicle”) and admits to being the registered keeper of the Vehicle (“the Keeper”).

    The VRM (I presume this is the registration number of my car) is NOT my registration number.

    If there is a hearing much later this year:

    Point it it as proof that everything is boilerplate copy & paste between one case and the next, the statement of truth merely tacked on the end in a different font/page and the person submitting statements never been to the site and has not even bothered to attend for cross-examination of this flawed statement.

    But DCB Legal have merely sent a reply to defence. Early days.

    Update: I have received a letter, Notice of Allocation to the Small Claims Track (Hearing) that a hearing will take place 10am, 21st March 2025 at Chesterfield County Court (see attached image for details).

    A week after this i received an email from DCB LEGAL;

    WITHOUT PREJUDICE SAVE AS TO COSTS
     
    We write to you in relation to the above matter.
     
    To assist the Court in achieving its overriding objective, our Client may be prepared to settle this case. I can confirm our Client would be agreeable to £100.00 in full and final settlement of this Claim. The current outstanding balance is £261.96.

    I see the Judge is so fed up with this abuse of the court system that he/she has included Special Directions for parking cases. Hoops for DCB to jump through.  Jolly good!

    So, here's my bit of fun;

    Dear Jenny,

    No. If you were serious, you’d have made that offer at Mediation. Your conduct is wholly unreasonable and I find it offensive considering the amount of time and stress this has cost me, i'm happy to have my day at court.

    I am preparing my Witness Statement and will attend any hearing. Given that I am self-employed, this process is already costing me significant time and money. My loss of earnings alone amounts to at least £700 (£350 per day for two days, one day off for court and all the time faffing with you before hand) as well as traveling expenses. When I succeed in court, I will be seeking to recover my costs in full.

    You are already well aware of the wider criticisms of the private parking industry and the aggressive tactics used to pressure people into paying unfair charges. If this claim proceeds, I will ensure the court sees it for what it is.

    I suggest you take a pragmatic view and discontinue now before I spend further time finalising my Witness Statement and associated costs.

    Our client has instructed us to discontinue Court proceedings and close our file. Therefore, please find enclosed the Claimant’s N279 Notice of Discontinuance for your records.
