PCN appeal rejected as an official appeal.

Hello everyone,

Six months later, I received a PCN through the mail. I appealed this PCN without naming the driver. I was prepared to file an appeal with POPLA because I had read on this site that the firm would reject it nevertheless. However, they did not accept my appeal as an official appeal.

They were neither rejected nor acknowledged as a successful appeal. The only reason that makes sense to me is because I had the impression that they were attempting to prevent me from appealing to POPLA.

Perhaps someone else on the forum have a similar situation to mine?

Your appeal does not appeal the issuing of the notice, therefore we cannot process this as an official appeal.

Please appeal against the issuing within seven days.

    Which PPC?
    When and where did the alleged event occur? 
    Plan A is always a complaint to the landowner and your MP. Have you done this yet?
    What was the reason given for issuing the charge?
    Was the NTK PoFA compliant?
    What did you put in your appeal?

    Which PPC? Have you revealed the identity of the driver?

    21 october 2023 if I tell the location will this be ok to not identify myself here?

    No I didn't complaint to landlord or MP.

    "This parking Charge has been issued to the above-mentioned vehicle due to a breach of the terms and conditions of parking at the location noted above. This charge relates to the period of parking that immediately precedes the time and date as detailed above.
    Evidence of this contravention can be found on our website www.paymyparkingcharge.com"

    I did read about NTK Pofa compliant and try to find any mistakes in their letter, but you know i could missed something.

    cut long story short I used your template in newbies section then I complained about their signs their are on multicoloured billboard too high, then is no signs at the entrance for example if you reverse car in that car park you will not able to see theirs terms. car park is small right off the main road basically you drive in of the main road to that car park. The opposite side of that car park is council pay and display machine.

    Then said about to sent PCN within 14 days protection of freedom act.

    Then about the evidence. Pictures they captured  one of the pictures shows car is reversing out the other is shows car is about to park but didn't parked in the place yet and looked like the driver is deciding to reverse out basically the camera took picture too early.

    And complained about grace period.

    They didn't answered fully to my appeal.

    And this is their full response.

    Please be advised, the Notice to Keeper does not have to be sent within 14 days of the contravention, this is the time frame for the Parking Charge to be reliant on the Protection Of Freedoms Act 2012.

    All signage on site is pre-approved by the British Parking Association and they deem this signage to be sufficient in notifying motorists of the Terms and Conditions on site.

    It is the motorists responsibility to read the Terms and Conditions, once the motorist has parked the vehicle and has been onsite over the 5 minute grace period they have entered a contract that they will adhere to the Terms and Conditons.

    Your appeal does not appeal the issuing of the notice, therefore we cannot process this as an official appeal.

    Please appeal against the issuing within seven days.

    Reply to that email telling them that clearly the appeal was sufficient (not that they can dictate what people say) and you will report them to the BPA if they fail to send a POPLA code.
