Refund or replacement

I have a branded  nailgun which is 11 months old purchased from.Amazon , yesterday it decided to fail it apparently has a 3 year warrenty .However, when another tool failed after only a few months I was offered a full refund. The problem I had was because the power tool is part of a specific set 1 battery fits all I have to get the same make and the refund did not cover the cost off the replacement fortunately I got over this with Amazons help ...I do know the price of my nail gun has gone  up so how do I stand, Should I contact Amazon or go to the companies customer care dept and  can I request a replacement or do I have to accept a refund and then pay another £20 for the correct tool to fit my batteries ..

    If a reasonable brand it may be better going through their CS as they can be pretty hot about protecting brand reputation. With Amazon they are entitled to refund with a possible deduction for use.

    It's generally the vendors decision whether to repair, replace or refund and they only have to put you back in the position you were prior to purchase, which means refunding your money.  They don't have to give you enough to replace a current version of the item.

    If you claim on warranty- which will be from the manufacturer- it will depend on what the warranty says they will do.

    Have you checked the warranty?

    Your rights under the warranty are whatever the terms say they are. 

    If exercising your consumer rights with Amazon, you may be asked to prove an inherent fault (as the onus is on the purchaser to prove this after 6 months) and they then have 1 go at a repair or replacement before you can reject for a refund. After 6 months, any refund can be reduced to take into account usage so if you’ve been given a full refund from Amazon in the past, this could be simply goodwill on their part. They’re not so good with goodwill with repeat complainers. 

    You have no right to more than the purchase price in any scenario (unless the warranty terms say you are which is unlikely).
