  • Standard mobility was in payment and then they took it away at MR stage. Currently there is no award.

    So the appeal has been lodged but DWP have missed the deadline for responding.  Today my daughter got a call from the PIP case manager but she missed the call. This has happened to me previously so I know an offer is pending.  we did call back at the end of the day but the case manager is now off until Tuesday.  What is the chance that they offer the same standard mobility award that we went to MR against?
    Presumably the standard award is already in payment so I can't see any reason they'd need to contact you if nothing had changed and they weren't actually properly considering the case.
    Lost at MR.... that risk realised probably in this case of arguing for a higher scoring MOB1 descriptor 1F undermined the case for the initially awarded descriptor 1E leaving neither awarded. (A cautionary tale because of course they're looking at what happens the majority of the time... and if you argue 1F applies then you're saying explicitly or not that difficulties associated with 1E do not apply for most of the time).

    In terms of the DWP case manager....hard to know but it hopefully will involve an offer.... frustrating a need to wait until next week... but I suppose it does give time to consider response if they did offer to reinstate the Mob 1E... Op come back here on strategy for that if necessary.. many may advise continuing to the tribunal given the flexibility of situation unless no real hope of better award.

  • The person I spoke to must have been managing my expectations as the case manager called this morning.  Offer was Std Care, Std mobility for 3 years which we accepted.  She was steadfast that my daughter did not meet the criteria 1 F Can't be unhappy though as she has an increased award and back pay to look forward to.

    You can still take it to tribunal if you feel she should meet the higher descriptor, accepting the offer now doesn't remove that option.  But that's good news she has an increased award in payment.

    Pleased you've at least got this off your desk and won't face the stress of tribunal dealings although as advised it is still an option to proceed.

    Given the general situation my advice normally would be to make some case, if not at appeal then, at review (likely to start in the last year of the award) for better descriptors applying as felt applicable... it's a tactic that worked for me in past even though there never was aim to increase award which would not have been appropriate... I've ended up with what I consider all correct descriptors. But in this case tread carefully if employing that tactic for the obvious reason of risk already understood regarding Mob 1F versus Mob 1E where they are guided that only one can apply for the majority of the time and so an unsuccessful argument for 1F could fatally undermine a case for 1E being fallen back on for outcome.
