No-one is being judgmental MM. However, just finding out about repossession less than 2 weeks before its happening is not possible. Chances are that the spouse was aware of it and was hiding the mail. If that is the case, what else doesn't the OP know?
Nobody would wish a repossession on anyone as it is not pleasant. I've attended many repossessions and in many, many cases it's been that one of the parties has been hiding post and the other party has no idea that they were about to be repossessed!
It's sad....but it happens.
OP....do you think this may have happened to you?My home is usually the House Buying, Renting and Selling Forum where I can be found trying to (sometimes unsucessfully) prove that not all Estate Agents are crooks. With 20 years experience of Sales/Lettings and having bought and sold many of my own properties I've usually got something to say

Or it simply could have been lost in the post. It does happen. They should have to send these things by recorded delivery.

To be honest I've read and re-read this thread and it seems like everyone's saying " I don't believe you, theres something your not telling me" - which on the face of it is probably true. What posters need to understand is (and I know this because I've done a lot of work with repo clients) when people find themselves in these situations, you have to be very careful how you ask your questions - as the slightest thing can upset them. They KNOW they have a big problem and they KNOW that a lot of a time they are the ones at fault. What needs to happen is they need to move forward and put some damage limitation into practice. I am sure no one here is doing anything to deliberately make the OP feel bad, but sometimes its a case of not what you say but the way that you say it. You might think I'm soft and treating them with kid gloves but I think thats whats needed.
I don't want to assume anything until we have this persons story, more facts, but I do agree with the fact that they should have been aware. However its not necessarily a spouse withholding the post, there could be a lot of reasons why they were not aware.
I know we all really want to help the OP, so OP please come back so we can try and sort you out - it might not be too late for youI am a Mortgage Adviser

One may go missing. I should know that as i receive about 2-3 misposts a week. However, would all the communications that lead up to the court case go missing?

MortgageMamma On reading this thread everyone has been totally helpfull and kind to relynutz. You were the first person to even state that people were being "Judgemental".
You say about being carefull about how you ask questions in thread above, as a slight thing can upset them but to be honest i would be completely tearing my hair out as advised by you to pack their belongings up incase its put out on the street and stolen(worse scenario). How is that different from asking a few simple facts like all the posters have ?? . Just dont see how you can say treat with care and then steam in with the full blown facts thats all. its not a case about beleiving ,people are trying to help. I dont think you were soft in saying what could happen no, definately not. No kid gloves i think you have told it how it could/might be .Just didnt see how you could then say treat with care . How are you gonna get the facts if you are worrying that the slightest thing will upset them ? Its different online poster wants help. Also as i always say with texts/email tones can be read into things like you have , I am reading it differently to the way you are perceiving it/ taking it in. I read it like people have been extremely kind and must cover my back and I know you are being kind too.

Ok fair comment teacup perhaps I am reading things differently from how people mean them.
As you can see by my job title I am a mortgage adviser. Sadly, during the summer due to a lead source I had I dealt with more than my fair share of reposessions. The first thing I tell anyone with a pending repo is to sort storage for their stuff, I do it out of kindness and consideration - its bad enough having your house taken from you without having all your stuff stolen from your doorstep when you have nowhere to put it. Believe me I have watched what goes on an bailiffs are not nice people.
I gave up working with heavily adverse clients in the autumn as it gave me too many sleepless nights, and it actually made me physically ill. (I am like a sponge when it comes to my clients stresses and like a lot of advisers I cannot just switch off) I felt bad for giving up on it, but it really was doing me in.
I think the OP has disappeared on us, perhaps they don't want to air the rest of the story publicly - there are plenty of people on here who could try and help them though so I wish they would come back. One of the things they could do to prevent the property being reposessed, even if it just buys them a little time is product a mortgage offer to the court.
You might think that is difficult but its easier than it used to be, there are certain lenders now that produce point of sale offers when you key through the application. Sadly, without knowing the OP's circumstances I cannot asses that this can be done, which is a shame as there may be a glimmer of hope there for them. There are also certain methods within the court documentation which may delay it a little.
You might wonder why I am so keen to help out. The reason is that I was evicted from a rented property (as the owner had sold, no other reason) just a week after my first child was born many years ago I was a single mother and I had nobody to help me and nowhere to go, and a week old baby (with jaundice) in my arms. The council were useless, it took them 3 days to sort me out a b&b. Its kind of a raw nerve with me this thread. the thought of three kids (I am a mother of three) on the pavement watching their house get emptied is heartbreaking.I am a Mortgage Adviser

The OP has posted on the Debt-free board and got specific advice on how to return to court to get the repossession set aside.
I did think that, if possession occured with furnishing in the property, access could be arranged at a later date.I'm a Forum Ambassador on the housing, mortgages & student money saving boards.
