being repossessd in 1 week!!!!

we are being repossessed on 3rd jan at 11am.
we received notification of this on 18th dec.

me and my husband didnt know that the case had gone to court or anything like that, the 1st we knew of this was when the letter came through the door last week!!!

have 3 children aged 8, 3 and 2.

we have missed 4 months mortgage £758 p/m

have been to local council but cant get an appt until same day as repossession but at 3pm.
i am so scared not so much for me but our children, i just dont know what to do.
i keep trying to phone mortgage compnay and solicitors but its either constantly engaged or rings until i get an answer service that is full and cant leave a message. cant phone council because they dont open until 2nd jan
any advice ? plz

    I am so sorry, you must be worried sick. Is it possible to contact Shelter (your post didn't mention that you had tried), as they can give you free, impartial emergency housing advice.

    Sorry - but it looks like you've left it a bit late to salvage anything from this. Lenders are getting ruthless. Missing one payment is bad enough, but four :eek:

    Get in touch with your Lender ASAP and 'throw yourself on their mercy' Maybe during this time of Goodwill they'll show some sympathy?

    Who is your Lender? It's not Sub-prime,is it?

    Post on the DFW Forum - you should get some good advice there.

    Its probably a bit late to seek sympathy from the lender. Not going to court wouldnt have helped your case (you would have got multiple letters about this. One can go missing but all of them?)

    Citizens Advice Bureau is probably worth a visit as this is the sort of area they are very good at helping out with.

    Phone all the debt charities that you can. This is an extremely busy time of year and some of them may be closed. CCCS is probably your best bet. I think National Debtline are closed until new year but try them anyway or have a look on their website. Both offer fantastic advice. CAB is of course good but you probably won't get an appointment until its too late. Ring your local council. If you're being repossesed you will be homeless and they have a duty to house you. Go over to the Debt Free Wannabee board and also the Living with Bankruptcy forum (on the DFW board) and get all the advice and information you can. There are PLENTY of people on there who have been in your situation. Put up an urgent post and see what they have to say. Good luck and keep posting. You'll be fine if you do some research - and quick!

    Sorry but it seems that someone may just of been hiding the post, its gone to court and u didnt hope u get sorted who was ur mortgage with?
  • If you go down to the local court on monday there is a form you can fill in to try and stop the reposessoin. if you put on the form that you have tried to make payment arrangements with the lender but they said everything you offered was too low and wouldnt accept it,a nd that you have kept phoning froma call box but could never get through, even after being on hold for half an hour at a time then you may just get the judge to be sympathetic and suspend the repo. get yourself to the local citizens advice bureau, they may be able to make a few phone calls on your behalf. contact friends/family about taking your kids in temporarily until you find alternative housing and don't hang about -- get your stuff packed and in storage or they are going to leave it on the street where it will be stolen. Storage can be from £10 a week if you look in the yellow pages look for big yellow storage.

  • I am an ex-building society manager and in my day (10 years ago) we would never have gone for a court order unless there was a background of missed payments. If this is the case, you may be unable to rescue the situation if you then missed 4 payments without explanation or an attempt to make reduced payments temporaririly. If the court notification letter was sent recorded delivery (which it should have been) and your payment record is poor, you may well be unlucky no matter what action you try to take now. If you can raise the money to clear all arrears immediately, you may have a chance.

    Sorry, but this sounds unlikely. Are you sure your partner hasn't been hiding the letters from you?

    Courts are very reluctant to evict people with young children, especially if you have no alternative accomodation. You need to communicate with your lender, the bailiffs and the courts, I assume you haven't talked to them all this time while you were missing the payments.

  • Just a note - have you been to court before? its unlikely that a judge will grant an outright reposessoin order on the first hearing, its usually a suspended reposession order and then full repo at the second hearing if you have not kept to any terms. I notice you've not responded to the thread - ignore those that are being judgemental there are people on here who genuinely want to try and help you
