What can I do to leave earlier during notice period due to stress from my boss and start new job

    You've had good advice, OP.
    On a more personal front - deep breath and grit your teeth. You are almost out, now. You don't need to engage with your boss any more. Just avoid any behaviours that would lead to instant dismissal, but beyond that, you are free!
    I was, I think, a fair and good line manager in my previous job. But even some of my best employees with whom I had excellent working relations, turned into clowns after giving their notice.

    You have a date you KNOW you legally must be paid to - i.e. your final day when your notice period expires.  Just stick to THAT date and plan the new job start date for after your final work day.

    Between now and then: be polite, work to rule, and if the stress is genuinely too much to cope with, self-certify a few days off ... then try again and see if boss has become more reasonable as he realises you are now out of the door and don't NEED to do anything above and beyond contractual duties. I find, people become reasonable at that point. You might find he then agrees to a handover action plan - in fact, I would recommend writing one for him to consider. If the stress is genuinely too much to cope with after the gentle threat, then see your GP for formal sick leave.

    DO NOT start a new job before your termination date.
    DO NOT start a new job while on sick leave.
    DO complete your full notice period with your employer.
    DO try to be reasonable.
    DON'T allow your boss to call unrealistic shots.

    You are entitled to be paid until your last day (+ potentially accrued leave).
    They can put you on gardening leave if they want you out earlier (you can't start a new job in that case).
    Or if you have a PILON clause in contract, they can do that (you could in that case start the new job, but might as well take a week or two respite time between jobs).

  • Hi. Thanks for all your comments. I haven't decided what I'm doing yet and will speak to GP as I'm really struggling at work. The atmosphere is awful, the way he speaks to me etc. I was never off sick on doctors note, only when I had my surgery and instead of being off sick for 8 weeks I came back to work. My sick pay is discretionary upon my boss' decision so I know he won't pay me the company sick pay but the SSP only, which is the only thing that is stopping me from leaving now.
