Seller as a change of mind.

Its my first time of moving house and wondered if you kind people could offer some advice.

My husband and i have sold our home as we wanted to invest in a larger property. We made an offer on a new home which was accepted and arranged for a survey to be carried out which cost £525, the survey was carried out last Wednesday,we havent got the report back yet but in the mean time we had a call Monday morning from the estate agents to inform us that the owners have had a change of mind and dont want to move!

My question is, is there anything we can do to be reimbursed for the costs and inconvienience?

    Shouldn't they have provided a HIP covering a survey etc or was it on the market before they came in?
    If it was on the market before, i'm afraid theres nothing you can do and you have to accept the loss of cash. I suppose this is the good point about HIP's?!

    The house came on the the market before HIPS came into force, so i geuss we shall have to put it down to experience and move on. I geuss the new HIPS system does have its advantages.

    A quick call to the surveyor may save you the costs of having the report written up.

    don't think hips would have made a difference, as the Survey is optional.
    Though they may have thought twice pulling out after paying for a hips.
  • I would check with your solicitor.
    You have incurred costs as a direct result of them accepting.
    I know in Scotland, an accepted offer, even verbally is classed as binding so there may be (and I guess there should be) something to cover people for these circumstances

    yeah, the best thing about hips is it forces people to actually spend some cash so it gets rid of a lot of idiots

    I agree. When you find your next house, make sure it has a HIP, if only to weed out the people who have put there houses on the market early to avoid one. Most, if not all, wont have a survey included, its optional at the moment.
    The agents round my way have actively encouraged sellers to put there houses on the market before the deadline for the HIP without a second thought for the buyers.

    Maybe thats because they are employed by, and paid by the SELLER!
