  • He was a sole trader I believe. The car was a CAT A write off. I am claiming against his personal name not his business. But the part I'm confused about is I bought it from him, but put the money into his business bank account rather than a personal account

    It's recommended practice for sole traders to operate a business bank account for their businesses - apart from anything else, using a personal account for this will generally be in breach of the bank's terms.

    The thing is a Cat A is going to have been a total mess, major structural damage, usually high speed collisions with unyielding objects, vehicles cut apart by jaws of life type incidents, burnt out vehicles etc. not something really repairable, it would usually require hundreds of hours of work to get them looking even half normal. One certainly could not pass an MOT, would not pass any vehicle checks etc. so I really wonder what has happened here.

    This is my point, which you have kindly explained further. It doesn't seem feasible to attempt to repair a Cat A. So, I agree, what has actually happened.

    This is my point, which you have kindly explained further. It doesn't seem feasible to attempt to repair a Cat A. So, I agree, what has actually happened.

    Well there are lots of questions as if an insurer deems a car a Cat A it can only be sold to a company with the appropriate license to crush the car so how did it get out the system and how did you get a clean V5c after registering it etc

    I am wondering if the car the OP bought wasn't the car which was a CAT A write off, but just has its number plate and chassis number etc. In other words a ringed stolen car. Because a lot of this isn't making sense

    It is a business account, not a limited company account. If so, you were correct to claim against him as an individual. And more chance of recovery, as he will have personal assets, whereas a limited company may have next to nothing. Rented yard and a phone line.
    Now you just need to start again with his correct name. A minor typo is not an issue, but geting the name backwards would be. Did you check the electoral roll first? 192.com?
