    This is not "put to bed" you have to accept the Draft Order from DCB Legal; did they ask you to sign anything when they sent it to you; who pays the N244 fee for a set-aside with consent?  Are you happy to have an order that states "no order as to costs".  
    Thanks for your reply. I have not signed anything. I paid the N244 fee and I want DCB Legal to pay!! 
  • Although I think I may have made an error, I was able to contact someone at the court who was willing to ask the Judge to change the hearing to a virtual one. They requested that I provide proof of being abroad and my return date, which I supplied. However, I also inquired, as I had here, whether I would still need to attend the hearing, given that the Claimant had submitted a Draft Order and would not be attending.

    They replied that the judge, in light of the Claimant providing the Draft Order and my awareness of it, has vacated the hearing. An Order will follow in due course.

    Has my implied acceptance of the "no order as to costs" deemed my unable to now apply for them?

    Yes you've let them get away fee free. That question cost you your £303 fee that you can't now get back.
