Your premium will increase anyway as a claim is made regardless who through.0 -
I am pleased to say I was paid by the insured insurance company for property damage. However certain items were not paid out on - items like damaged fences etc and whilst the insurance company have sent a cheque it’s for a minimal amount which I can’t accept. I’ve raised a complaint but my question is if they refuse to up their offer and the total sum is approximately 6k and I take them to court who would I make the claim against- the insured or the insurance company given the insurance have admitted liability and made a payment just not enough to put me back in the position I was before their insured hit my property

You would normally litigate against the person you are holding liable, their insurers will respond on their behalf0
