MILWAUKEE® Garage Takeover 2024

Terms and Conditions (the “Agreement”)

MILWAUKEE® Garage Takeover 2024

1. The MILWAUKEE® Garage Takeover 2024 ("MILWAUKEE® Garage Takeover") is promoted by Techtronic Industries EMEA Limited ("Promoter").

2. Entry into MILWAUKEE® Garage Takeover is deemed acceptance of this Agreement.

3. The MILWAUKEE® Garage Takeover is applicable to representatives from professional automotive garages in a participating UK or European country (Belgium, Netherlands, France, Switzerland, Austria, German, Romania, UK, Spain and Portugal) who are aged 18 years or over at the date of entry. The MILWAUKEE® Garage Takeover will be void and non-applicable where prohibited by law and is subject to all applicable local laws accordingly.

4. Employees, officers and directors of Promoter and its affiliated companies or their family members or anyone else connected in any way with the MILWAUKEE® Garage Takeover or helping to set up the MILWAUKEE® Garage Takeover are not eligible to participate.

5. Proof of eligibility may be required, and participation or prizes withheld until Promoter is fully satisfied the above criteria are met. Promoter’s decision is final, and no correspondence will be entered into.

6. The MILWAUKEE® Garage Takeover is limited to a maximum of one submission per person. Any entrant found to be cheating will be excluded.

7. There is no entry fee and no purchase necessary to enter this MILWAUKEE® Garage Takeover.

9. Entry into the MILWAUKEE® Garage Takeover is open from 1 February 2024 until 30 April 2024 (“Entry Period”).

10. To enter the MILWAUKEE® Garage Takeover entrants must enter their name, work email address, work mobile number, professional trade , company name, function within their company, company size and detail on the company relationship with MILWAUKEE® within the following form: https://www.milwaukeetool.eu/garage-tour-2024.

11. Those selected for a MILWAUKEE® Garage Takeover shall be selected at Promoter’s sole discretion based on the information provided by the entrants in the form detailed above. Any MILWAUKEE® Garage Takeover visit is not guaranteed by MILWAUKEE® and are always subject to prior approval by the Promoter.

12. Those selected for a MILWAUKEE® Garage Takeover will be contacted directed by the Promoter to organize the visit.

MILWAUKEE® Garage Takeover Campaign – Bonus Prize

13. By providing information in accordance with section 10 entrants to the MILWAUKEE® Garage Takeover will be automatically entered into a prize draw (the “Promotion”).

14. A prize will be awarded to one (1) winner chosen at random by computer-generated selection by the Promoter from all valid and correct entries. The winner will be announced on 1 May 2024. The winner of the draw will receive the prize as indicated in Annex 1.

15. The winner will be notified by email where the Promoter will request a delivery address for the shipment the prize. If a winner cannot be contacted or does not claim the prize within fourteen (14) days of notification, the Promoter reserves the right to withdraw the prize from the winner and select a substitute winner. The Promoter shall have no liability for the winner’s failure to receive notices due to spam, junk e-mail or other security settings or for winner’s provision of incorrect or otherwise non-functioning contact information.

16. Promoter is not responsible for inaccurate prize details supplied to any participant by any third party connected with this Promotion and no cash alternative to the prizes will be offered. The prizes are not transferable. Prizes are subject to availability and the Promoter reserves the right to substitute any prize with another of similar characteristics and value without giving notice.

17. The prize will be delivered within thirty (30) working days from the date the winner provides their postal address to the Promoter.

18. The Promoter’s decision in respect of all matters to do with the Promotion will be final and no correspondence will be entered into.

General

19. The Promoter reserves the right to cancel or vary these terms and conditions at any time without notice. Any changes to MILWAUKEE® Garage Takeover or the Promotion will be notified to participants as soon as possible by Promoter.

20. Personal data relating to the entrants will be used for the purposes of this MILWAUKEE® Garage Takeover and the Promotion in accordance with current GDPR legislation and the Promoter’s Privacy Policy available at https://www.milwaukeetool.eu/footer/privacy-policy/. The Promoter reserves the right to contact all entrants to verify their personal data.

21. The Promoter shall not be liable for any disruption to the MILWAUKEE® Garage Takeover or the Promotion whether due to force majeure or other factors beyond the Promoter’s control.

22. In accordance with all relevant legislation and codes of practice, the Promoter reserves the right to suspend or modify the MILWAUKEE® Garage Takeover or the Promotion. If such modification or suspension occurs, Promoter will make a commercially reasonable effort to post notice of such on Promoter’s website.

23. To the extent permitted by law, entrants agree to release and hold the Promoter harmless from any and all liability whatsoever for any injuries, losses or damages of any kind arising from participation in or in connection with the MILWAUKEE® Garage Takeover or the Promotion, indirect or direct, including without limitation, awarding, acceptance, receipt, possession, use and/or misuse of the prize, technical difficulties or any malfunction. The above limitation of liability shall not apply to liability arising from fraud (including fraudulent misrepresentation), death or personal injury caused as a result of Promoter’s negligence.

24. The Promoter, its suppliers or resellers associated with the MILWAUKEE® Garage Takeover and the Promotion shall not be held responsible for any delay, damage or loss caused to the prizes in transit.

25. If any provision of this Agreement is held invalid by any law or by the final determination of any court of a competent jurisdiction, such invalidity shall not affect the enforceability of any other provisions not held to be invalid.

26. This Agreement is governed by English law and any disputes will be subject to the exclusive jurisdiction of the courts of England.
