Might want to edit your post to remive personal data.1

Can't obviously see anything I've missed other than my surname which was intentional. Please let me know if there's something else though.ThorOdinson said:Might want to edit your post to remive personal data.0 -
We need the info shown; it's intentional otherwise how can we cite the case?PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Yeah it's a bit unfortunate that you have to dox yourself in order for other people to benefit from your case.1 -
Did you get the written short judgment from DJ Ramsden that confirms you won your claim?dxbcc said:This is brilliant! Well done on winning this claim against UKPC!
So others can quote it, can you tell us:
Claim number
Date of hearing
Judge's name? Thanks! I couldn't have done it without the incredible advice on this forum. The case was L6QZ0K0Q, Charlton vs UK Parking Control Ltd, 17/04/2025 and it was DDJ Ramsden.I have high hopes of some PPCs being fined by the CMA in future, in view of their new powers this month as a result of the DMCC Act.I would certainly love to see that - thanks for the article link. It's hard to think of any other group that relies on unfair and unreasonable behaviour at such scale as the PPC industry.
That will help us cite it in future, alongside Simon Clay v CEL. Assuming you are happy the case is cited as claim no. L6QZ0K0Q judgment by DDJ Ramsden sitting at the County Court at Canterbury - 17/4/2025 - Charlton v UKPCPRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Ahhh, sorry for the delay here - I missed the reply! Here's a copy of the judgment - it was originally a bit of a mess because the court put UKPC's address in the address for payment box in the original copy. I asked them to fix it, then UKPC paid up on time anyway. The court sent another copy, with the same mistake!

Hooray, thankyou. 😀Could you confirm:
- How much did you claim for?
- Did the £200 include your costs?
- Please show your pleaded claim wording?
- Please show this (redact names and car numberplate):
I received their defence today. They're putting a lot of emphasis on how it's not their fault the site management mixed up my number plate, and claiming that the parking charges were validly issued for breach of terms and conditions. I was parked in a building specific private car park with the express permission of the leaseholder / management agent. For added fun they've claimed that they were unable to comply with the SAR because they no longer have the photographic evidence or copies of the notices or the appeals. That means they're not complying with the BPA CoP audit requirements. They've also stated they believe the view of the ICO that VRMs stored for parking enforcement purposes are personal data is "not relevant". An interesting choice.
Their internal process failures (and ANPR camera that reads vehicles too early) are unfortunate but their terms never applied so I could never have been in breach of them, and that unpicks almost all of their defence.5. And please show your witness statement and evidence you submitted the month before the hearing?

- I claimed for £320, comprising £120 for my time, and £200 for the unlawful processing of my personal data. The Judge didn't allow the £120. The gist of his argument was that it was a double dip at compensation for the same breach.
- £309 in total, £200 for the data protection breach and £109 for the court and hearing fees. I didn't push for any other expenses in the end, we were already running very late at the end and it wasn't really about the money. I'd also received some bad news about a family member's health earlier that morning and was keen to get away as soon as possible to see them.
- There's a copy of my redacted claim and WS at - I can't really include any of the evidence bundle, there'd be too much to redact. I'm sure they're not very good by the standards of the forum experts, but hopefully of interest.
- Are you after the whole defence here?

My documents
As the MSE folks have asked for a copy of my claim and witness statement, here’s a redacted version. I can’t include the evidence bundle as it contains details I can’t really share, but here’s a summary of what was present.
- Site Maps, including signage locations - page 1UKPC Sign (June 2023) - page 2OCP Correspondence - page 3UKPC correspondence - page 26Detailed Site and Signage Photographs - page 89DVLA Subject Access Request Response - page 94ICO SAR Response - page 98VRM Storage by UKPC - page 100ICO guidance - page 101ICO decision notice FS50793373 - page 122POPLA Appeal timestamps - page 142POPLA Appeal - page 143POPLA Correspondence - page 145
I also included the judgment for Simon Clay vs. Civil Enforcement Limited which the Judge in my case found pursuasive, a copy of Vidal-Hall vs. Google and the British Parking Association Code of Practice that was in force at the time.
That link you provided is great! I don't think we need their defence. We can imagine that template drivelA thorough walkthrough how to claim.
