Read again my post of 10 April at 3:51PM.
You will note that you have received 'an early copy of the Claimant's DQ' - sent to you by the Claimant - and that is why it doesn't show on your MCOL history.
As your MCOL Claim History doesn't show that the CNBC has sent you a DQ to complete, you have nothing to worry about.1 -
Ok great I will keep an eye on it. Thanks @Coupon-mad1

Does that happen often? @Coupon-mad0

Sit tight & check the Claim History once a week. Might take months for the C to realise this one hasn't moved.
Not for you to resurrect it!
If it stays quiet all year, email the CNBC in 2025 and tell them:
Because the case has been stayed so long, the claim should be struck out. Failing that, this note must be placed with the case file to alert the Judge that the address for service of the Defendant cannot be assumed to be the same indefinitely for the rest of the Defendant's life. That would be absurd and unfair. Thus, if the Claimant fails to resurrect the case by the first year anniversary of it being filed. The Court must note that the Defendant's address MUST NOT be presumed to still be good for service of court documents and the Defendant must also be emailed on (your email address) if there is any movement on the case.PRIVATE 'PCN'? @Coupon-mad still have not heard anything about this case moving forward and the last thing stated on MCOL history is when my defence was submitted.
I can never get through to them via telephone so I was thinking to email them to ask the claim to be struck out due to the period in which the case has stayed stagnant. However would it be better to let it drag out longer and then email in several months. It's already approaching 9 months.
Has anyone else experienced this?0 -

Sure and I am considering it but I am just asking if anyone else has been in a similar boat and if I should wait even longer. Is there a particular time period before they discontinue the case?0

any one else had this delay with the claim against them?0

Yep, I replied yesterday to someone in the same situation. You'll find it if you search the forum for NEWEST results with keywords:

Hi All, just an update. I called the number and managed to get through to CNBC.
They basically informed me that this can happen where a case is stayed. They did say that emailing would not change anything and that the only way to ask the case to be struck off would be a formal application to the district judge which would cost £300. Seeing as that is more than the actual claimant amount of £265 this makes no sense. She was quite certain emailing would do nothing at all.
The other option they said was to email Gladstone solicitors and ask them what they are doing but from what I gather as the case has been stayed it would cost them about £113 for case to re-proceed and doesn't cost them anything more to keep it like this.
The other option she said is just do nothing and it stays like this indefinitely unless you hear anything but again I may have an address change in future and don't really want this hanging over my head.
Any thoughts on advice following my call to them?
