Judgement for Claimant

Hi all,

My 'friend' received a claim form on 27th February for three PCNs on 24/05, 25/05 & 27/05. Annoyingly, said friend did nothing with the claim form as he vaguely remembered paying them at an earlier stage.

He has now received a Judgement for Claimant (in default) dated 21st March from DCB Legal. I've read through the newbie post and not sure the best approach to take here. Obviously he would like to avoid a CCJ so will reluctantly pay what they are requesting - would you go down this avenue or request to have it set aside? 

The claim form referenced this website, which doesn't feel very official - money claim.gov.uk whereas the more official looking one appears to be moneyclaims.service.gov.uk, and when I type in the claim number on that second one it says that it isn't a valid claim number.

Any help gratefully received, and apologies if I have missed the right section in the newbie post - we are moving house on Thursday but appreciate the time sensitive nature of this.

    It was a real claim - MCOL is the county court online claims system.  He could have defended it and paid nothing at all.

    Sadly, it is now too late and he has few/no grounds to set the claim aside because he was served with the Claim Form but ignored it.

    He'll have to pay it in full immediately or they'll pass it to their HCEOs to come round with a warrant.  It is a claim for over £600 so that means High Court Enforcement (bailiffs).

    What an expensive error.  He only had to do a Google image search to know it's a real claim.

    By ignoring the Claim your 'friend' has no other option other than to pay what is now being asked for.

    Sadly he failed to understand the importance of defending himself.

    Failure to pay within the timescale stated on the Judgment will see your friend's ability to raise credit - think mortgage, phone contract, etc - hampered for the next six years.

    If he doesn't do it this week it'll be with DCB's bailiffs by the weekend (and they'll add £200 that I think exceeds the rules but that's what they reportedly do).  And HCEOs can clamp cars.

    HE DOES NOT HAVE 30 DAYS.

    DO NOT RING DCB LEGAL TO PAY, BECAUSE THEY WILL PUSH HIM TO SPEAK TO DCB LTD WHO WILL ADD THE £200.

    He must use DCB Legal's portal online.

    Then he can pay the judgment as ordered.  This is so sad because with us, had he come here 2 weeks ago he'd have paid nothing.

  • Thank you @Coupon-mad, really appreciate the advice. I'll get him to sort it out tomorrow. Yeah I've read through quite a lot of the posts on here and just gutted really, at least we know for next time (fingers crossed there isn't one!)

    Judgements are payable straight away, if you pay within a month of the judgement no CCJ will be recorded on their credit file. If it goes over a month then it will show on their credit history for the next 6 years as outstanding or settled as appropriate.

    But because this is over £600, DO NOT WAIT.  You can be sure this will be straight to DCB Ltd with a HCEO warrant by next week.
