Refused refund, where do I go next

    It was a later post where they mentioned the "less than 14 days". :)

    Where does the OP say that? All I can find is a comment of "in my home for less than 14 days". 🤷‍♀️
    The OP actually said:   "I was very careful with the item, tried it on once then returned it to its original packaging until it was collected by the company. Ten days after it was collected from me...".  So any delay in return would seem to be down to the seller.

    I'd still like to know why they didn't just ask for the right display case to be substituted for the wrong one.
    I am inclined to agree.

    Whilst I appreciate that for the OP this was an expensive purchase and they wanted everything to be perfect - I will repeat what I posted earlier that I very much doubt the packaging will make any difference to any possible resale value of a £2k watch (which is likely to be a lot less than the OP might hope for/imagine)

    You need to get into serious money for future resale to be of any consideration and everything needs to be pristine - so no wearing of said expensive purchase

    Yes I know.  that's why I quoted your post saying that.

    @Arunmor seems to have misunderstood the circumstances -  believing that the OP waited 14 days to return the item.  As I understand it the OP had to wait for the seller to arrange to collect the watch.

    The OP didn't wait to do anything.  Any delay in return is clearly down to the seller - not the OP.

    I'd still like to know why the OP didn't just ask for the case to be replaced.  Asking for a refund just because* the case is damaged seems disproportionate to me.


    *Of course the OP might have (or have had) the right to cancel the purchase as a distance contract under the The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 (legislation.gov.uk), but I'm not sure if they've followed the steps necessary to exercise that right.  That's why I'd always advise consumers to tell online traders that that is what they are doing and not using the traders own vague returns policy - unless the trader's own policy gives a better deal.

    See the Legal Beagles thread I linked to earlier where the seller eventually agreed to pay a refund.  Not sure if they actually hav epaid up yet or not...

    Had this happen with a Garmin - 99% likely it was a display model that was put back into the (wrong) box, and there's another box somewhere which would match.
    OP - I can't speak for condition etc, but I definitely support the point that it affects resale value and is integral to the package (even for watches in the hundreds).

    You also need to check any warranty card etc (such as for sending back for repair, new battery/service and so on), if the serial on the watch isn't what is registered on the card, then you may not get any cover there.

    (FYI - my garmin - I ended up selling it to CeX, and they downgraded it's condition simply because the box sleeve didn't match even though they agreed the watch was still immaculate).

    Resale isn't the only factor, you might not want to give a gift with the wrong box. Whatever the reason, it's not pertinent to what you're entitled to receive.

    Manufacturers package their items nicely for a reason when they could just stuff it in a manilla envelope. It contributes to the luxury feeling. Otherwise why not take it a step further and say the strap condition etc doesn't matter, you're buying a watch face / mechanism, the rest just holds it in place.
