Paying Excess on someone else's policy when they are at fault

Hi. We had a rouge builder who caused a huge amount of damage to our home. He was insured with NFU using a trade policy for liability. They have offered a settlement at only 10% of the actual damage caused. They are deducting from the settlement figure his excess payment ??, surely this cant be right. Does anyone know if this is correct, I have checked the FCA website but cant find anything specific or clear.

    He is insured not you, you claim from him, he claims from his insurance. His insurance will pay him net of his excess, he passes that money on and pays you the excess himself. To stop them being a middleman sometimes the insurer will deal with you directly in which case you have to chase him for the excess.

    The fact that the builder's insurance is paying our suggests that there is a degree of acceptance of liability.  Looks like the next step is court action, so that the total money you receive compensates for the damage caused.
