DISCLAIMERS

Does a ‘disclaimer’ printed on the back of a cereal box warning of fruit ‘pits’ finding their may in the box sufficient protection of manufacturer’s liability? I bit on one eating the cereal and broke my tooth which now needs root canal (where feasible) or extraction/implant. I didn’t see the small print on the box. Is this a case of "buyer beware"? Does anyone have any experience of whether I’d have a realistic chance in making a successful claim for damages against seller? Don’t know if there are any consumer rights applicable in these instances. The manufacturer has denied liability or neglect of duty of care but has made a small goodwill financial offer in response to my complaint.

You might find a letter in the money section of yesterday's Sunday Times interesting; someone broke a tooth on a maize kernel in a packet of M&S tortilla chips. M&S were persuaded to pay for the resulting dental work.M&S snack left me with a £3.9k dentist bill0

I read that article too.. hopefully the recent press coverage may help the OP.
I think it may be significantly different in this case however as the tortilla chips are made from ground maize which sieving should have prevented the issue had it been a foreign object. The OP doesn't state whether it was a box of granola or cornflakes.0
