Lump sum/benefits

Hi All,

I got a lump sum off money in June last year £35,000 ( firty five thousands pounds).
It's from my ex partner trust fund he was born too early and suid the NHS.

I was given a lump sum for caring for him for a year as his carer. 

I didn't want the money I did everything in my power to not receive it.
It's blood money half of it was based on nothing but lies 

But because it all went trough court the money was named to me.
So I had to have it.

So I reveced the money and told housing benefit, tax credits ect... That all stopped because of the lump sum.

I have a profoundly disabled child of 9 years old. 
I tired to leave all the money to her for when I die.
But a solicitor said I couldn't do that.
As I won't be able to claim benefits again. 

I have 23,000 left and when I get to 10,000 I can claim benefit.

I haven't spent it on anything wild.
I can't go on holiday or anything wild 
I gave £1000 to social services for an adaptive chair for respite for my daughter. 

I can prove with bank statements that I haven't spent it on nothing.
Only bills, taxis as I can't drive and my daughter can't walk.

My question is: 

Can I still claim benefit when I get to £10,00?
The money will run out and I have done nothing with it. 
I can't even leave anything to my daughter

PLEASE don't judge this money as given me nothing but horrible depression. 
It's dirty blood money based on lies and I never wanted it.

    When it is below 16k you can claim Universal credit.

    I believe that the lump sum was classed as income for your TC to stop. 

    The threshold for new Universal Credit claims is below £16K, however your claim will be subject to a reduction of £4.35 for every £250 or part of, over £6K.  As there is nothing that stipulates it should be left to your daughter, if you put it in her name then DWP will class it as still being yours.

    A new UC claim will look at a housing element.

    When I saw a solicitor they said they something about depravation of assets.

    "Spending or getting rid of money to claim benefits" 

    I haven't done this the moneys all been spent on bills, taxis ect...

    I'm scared they'll say I can't claim housing benefit. 
    Then I can't pay rent then I'll lose the house.

    You will not be able to claim housing benefit again but if you claim Universal credit that will include an element to help with your rent. UC rent element replaces housing benefit.

    Why can't you go on holiday?
    It is, so far as  understand, all about reasonableness.  A normal type of holiday would be considered rather differently to an outlandish extravagance holiday - the latter might be considered DoA (deprivation of assets).

    You can claim UC once your capital reduces to £16k, not as low as £10k.

    There are some benefits that are not means tested.  Are you entitled to any, or entitled to any as support for your daughter?
    Are you claiming child benefit?

    I get DLA for my Daughter and child benefit. 
    I'm just scared to spend anything. 
    Just incase DWP say no to claiming benefits because I've spent it too quick. 
    I haven't spent anything really just all on bills.

    If her DLA includes either mid/high rate care then you can claim carers allowance for looking after her, providing you do not earn more than £139/week. You can put a claim in now and ask for it to be backdated for 3 months.
