Claim Form | MET Parking | DCB Legal | Location doesn't exist any more!

Good morning all!

This is my first Claim Form thread. I've been reading a vast amount of all your wonderful posts and would love some guidance to appeal this, and will hopefully add to the growing number of wins against this organisation. I am non legal-wise and I will try my best to do everything as laid out in the NEWBIES thread etc, so please excuse any newbie moments.

Received a Claim Form from DCB Legal on behalf of MET Parking Services Ltd

    1) This parking charge was from 07/08/18 (not unusual).
    2) There are no pictures (I'm guessing there is no point in asking for a SAR request?)
    3) THIS LOCATION DOES NOT EXIST ANY MORE. The Peabody estate in question, that existed in 2018, has now been demolished (can provide pictures from a visit to the site that I conducted 2 days ago)
    4) MET Parking services lost the tender to manage Peabody estates parking in 2020 (can provide link).
    5) I, as the registered keeper of the vehicle, have not engaged with MET Parking Services or DCB Legal (following old advice about throwing away anything from these organisations).
    6) I will submit my MCOL AOS later this afternoon as stipulated in the MCOL AOS Help document.
    7) I am no longer the owner of the vehicle in question as I sold it to trade after a rather catastrophic cam belt failure - what documents do I need to prove this?
    8) For later statements I will be adopting the 'I was the registered keeper and likely driver' approach (need to find the latest thread I was reading).
    9) Actuality of case: I am a Location Manager in the film industry was visiting the estate wanting to see the estate as a potential location. There were no designated bays on the estate (usually estates like these have dedicated visitors bays) and was trying to find the estate manager / office to discuss both the viability for filming, but also was it OK to park where I had? I couldn't find the manager and by the time I returned to my car (after having seen some parts of the estate) I had received a ticket. The boards from MET are located high up on a wall, out of sight for a driver, and there were no MET boards to be seen on entrance to the estate from the road (as can be confirmed from a google street view image from the time). 

    You guys are fantastic at helping people navigate these pressures, and I'm very thankful for your help. I can provide pictures of the Claim Form for the POC - last time I drafted a post the site crashed so I am retyping here. It may be because I am new and there are restrictions. @Coupon-mad thank you for all you've done for others, looking forward to working with you.

    The older help form says that I have 33 days to compile a defence from the issue date which was 18 Mar 2024.

    Is this still the case?

    @KeithP will confirm your defence deadline.

    The fact you sold the car is irrelevant but put the rest in as your facts paragraph 3 using the Template Defence.  You'll win.

    MET parking must have the biggest rubbish bin around.  To dig out such a rubbish claim from 2018 is a sign of desperation

    THEY WERE SACKED and even if they have pictures of the signs going back to 2018, the one thing for certain is that the signs DO NOT MENTION DAMAGES

    DCBL are famous for taking rubbish cases to court and that is why they discontinue all the time ???  

    The fake claim for damages is just that A FAKE and the lady who signed the claim could be charged with contempt of court

    Once DCBL see your WS it will be a wake up call that this is yet another rubbish claim  ...... only two options open to them ,,, GET SPANKED IN COURT OR DISCONTINUE

    You now wait for daft letters offering you a discount which you ignore

    THEN .....

    Your acknowledgment of service was submitted on 25/03/2024 at 10:10:57

    Do I just need to *wait* to see 'Your acknowledgement of service was received.... XXXXXX' - On Hharry's post it seemed to arrive approx 2 days after submission?

    Just wanting to check that I've done the right thing on the MCOL website and that I've not made a submission error.

    After listening to feedback from residents on our parking policy, and consulting with you on our procurement for a new provider, we have entered into a new main parking contract with Parking Control Management (PCM) to help us keep our estates well-managed and maintained.

    PCM currently provide parking management services across a number of Peabody sites, which will automatically move over to the new contract from 1 January 2021.

    What’s changing?

    • If you live on a site currently managed by MET Parking:
      Our contract with current provider MET Parking will end on 31 December 2020. The estates currently managed by MET will be transferred to PCM from 1 January 2021 as part of a phased plan.

    No and you aren't using the hharry defence anyway. As I said already:

    "The fact you sold the car is irrelevant but put the rest in as your facts paragraph 3 using the Template Defence.  You'll win."

    No need to overthink this & no evidence goes yet. They'll discontinue before the hearing anyway.
