An update on my case however I am awaiting directions from the court but I have now filed a default judgement against civil enforcement as they had 14 clear days from the 20th of April to respond to my counterclaim which they have failed to do!1 -
Marvellous...so far! BUT:
Keep pushing for default judgment (ring EVERY DAY) as the CNBC have an unfair ("potentially illegal" IMHO, and I've told the CJC this) two-tier system:
- Claimants are handed a single online push-button to AUTOMATICALLY claim judgment in default of a defence. No human checks. Decisions made automatically by a computer.
- Part 20 Counterclaimants like you have NOTHING similar. Worse, when people fill out the form to request judgment (in default of a defence to counterclaim), the CNBC kicks the can down the road. I've seen Claimants handed a lifeline: an Order allowing them more time to defend is common; one (eventually successful at the hearing months later) Counterclaimant was outright refused default judgment with the Judge saying that it was 'inappropriate'.
You could not make it up. Expect brick walls.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi sorry bot been getting notifications. So today I had my hearing and lo behold simon did not turn up but the judge was very helpful to me. She basically had told thr claimant counsel off for simon not being present hindering my ability to cross examine his statement. Also the judge did not take very kindly to the claimants statement about signage around the carpark which they are relying upon too. Under cross examination I basically pleaded I do not recall the signage that the claimant has alleged was posted at the site and the judge basically dismissed the claimants claim. As for my counterclaim due to lack of medical evidence that too was dismissed but the main takeaway here is the claimants claim dismissed whilst I'm out of pocket £50 they going to be more out of pocket as they got counsel fee to pay now.2

Great that you won. Pity that your counterclaim was thrown out although that was always predicted.
