AA car warranty

Purchased a car from AA approved dealer with 3 month warranty covering engine/gearbox 
42 days after purchase the clutch went. 
I have advised the dealer who say it’s not covered 
can anyone help please.

    Clutches are normally considered as wear and tear items by warranty companies.

    I assume this is an older secondhand car so unless you can prove the fault was present when you took delivery I wouldn't hold your breath that they'll cough up.

    The clutch is not a component of the engine and gearbox. It's a separate unit. The warranty would need to include the entire drivetrain to cover it.
    If you look at these insurance-based warranties, they exclude almost everything that is likely to fail, and so are effectively worthless. They are simply used as a marketing tool, because 'AA warranty' sounds reassuring.
    Unless the vehicle condition was mis-described, you are on our own, and CRA 2015 will not help. Was it?

    What age, what mileage, how did the clutch "go"?

    What does the warranty documentation specify is included and excluded?

    Have you spoken to the actual scheme administrator, or just the dealer who sold you the insurance policy?

    Wear and tear will almost always be excluded, though, and the vast majority of clutch failures are... wear.

    If the failure is the clutch hydraulics leaking, then (even if fluid leaks are covered, which they often aren't), can you prove the fluid had previously been replaced at the correct intervals?

    This threat will go back and forth.
    But the simple answer is, wear and tear.
    No claim possible.
    Clutch, brake pads, exhaust, tyres are excluded.

  • Yes it is an older car 2011. We had only had it 5 weeks. The Warranty covers gearbox and engine and we had only done 460 miles. There was just no drive at all. No slipping beforehand. 
  • Have only spoken to Dealer. Should I speak to AA Do you think?

    You have nothing to lose by trying.

    You never know.... But unlikely a clutch is covered as pretty much anything that goes wrong with a clutch is "wear and tear".


    Suddenly losing drive without warning doesn't sound like clutch wear though, they usually slip for a while rather than completely stop working.

    Suddenly being unable to select gears with the engine running is more likely, as some cars are known for the release bearing suddenly punching through the clutch spring when it wears enough.

    Someone else will have to chime in here, but if you paid top dollar for the car at a dealer, it is a reasonable expectation that it lasts more than 460 miles, people quote the consumer Rights act 2015 and claim that any serious fault within 6 months must have been present at the time of sale, and the dealer's responsibility to fix.

    e.g. if the clutch was 99.99999999% worn when you bought it, and in 460 miles you wore it the extra 0.00000001% then they sold you a car with a worn out clutch, and should fix it.

    The dealer should at least asses the car and say whether the clutch is worn out or something has broken rather than just blank you with "Wear & tear- not covered".
    I want to go back to The Olden Days, when every single thing that I can think of was better.....

    (except air quality and Medical Science ;))
