The accounts (companieshouse.gov.uk) are pretty peculiar and suggest that there is little prospect of getting anything from the company. You might be able to go after the director (I.M...) if he has any assets, but that would need an accountant and a lawyer.0

The NHBC point would be moot in any event as the developer isn’t registered. It certainly looks as though Empire Homes have been in quite a lot of difficulties - last summer HMRC filed a winding up petition against them - it was dismissed in September but this does suggest that they have significant financial difficulties. If you are planning to take the court route OP, probably best to get a shift on.🎉 MORTGAGE FREE (First time!) 30/09/2016 🎉 And now we go again…New mortgage taken 01/09/23 🏡

The big question is whether the builder has any assets.
An earlier post suggested they still have a property they are yet to sell. Is this right? If they have assets then the claim is worth pursuing.
This is them on Companies House:

Should've = Should HAVE (not 'of')
Would've = Would HAVE (not 'of')
No, I am not perfect, but yes I do judge people on their use of basic English language. If you didn't know the above, then learn it! (If English is your second language, then you are forgiven!)0
