NCP NTK received after 14 days

Hi,
just received this NCP NTK on Thu 14/04/2024 for a parking charge from 23/02/2024 (14 days after would've been 08/03/2024). Says it was sent on 11/03. This was for an NCP car park in Manchester - Manchester Palace, Whitworth St, M1 6NE. Not sure who owns the land or if any of the arguments about landowners are relevant.
I've read the newbies thread and still confused - they don't mention POFA in the NTK, are they bound by the 14 day rule? They say that if they still don't know the driver after 28 days they have the right to recover costs from the keeper. Is that correct?

The date you actually receive the NtK is irrelevant. It is the date that it is "deemed served" that counts. that date is two working days after the date of the NtK, which in this case is 11/03/2024.
Whilst the NtK attempts to use PoA wording, it cannot rely on PoFA as the date of sending, 11/3, is too late. Therefore, whilst they say they will hold the keeper liable, they cannot. As long as the keeper does not identify as the driver, they cannot pursue the keeper.
So, use the standard appeal as per the Newbies/FAQ thread or just appeal as the keeper and tell them you decilne their invitation to pay or identify the driver. Tell them that they should cancel the PCN or send you a POPLA code where you both know that NCP have no chance of winning.2 -

There are several lies and omissions in the NTK, including,
The ANPR system used by the PPC is not approved. Only the Secretary of State can approve such devices, but has not done so, not even for council or local authority car parks.
NCP will not have the right to recover money from the keeper if the driver isn't named.
