BMW wont refund me for a wrong Part

Im writing this on behalf of a friend who has recently had this issue 

My friend has a BMW M135i and cracked his splitter. My friend then went to Peter Vardy BMW Edinbough, who supported him in purchusing a new splitter from BMW at a cost of around £500. My friend then collected the part when delivered, to realise the part was not correct, as it was not the same as the body kit on the car. 

Said friend returned to Peter Vardy BMW to explain this and was greeted with a 'we will get this refunded' 
to his supprise, when the assistant entered the information into his computer to BMW to request a refund, they REJECTED the refund as they state that the part is the correct one for the car (not the body kit) my friend also believed the car was standered and the body kit was on all of them.

My friend purchased the part on Tuesday 5th Feb 24 (Today is 14th Feb 2024) 

With the part refund rejected my friend is now left with a £500 splitter that doesnt fit his car and the assistant at Peter Vardys BMW said to leave it with them and 'when' they sell it, they will send him the money. 

What are my friends options? is this a total loss? or does he have some rights to which he will be able to get a refund?

    Does the past tense in this last comment suggest that he's now realised that his car isn't standard?  If so, to what extent did PV physically check the vehicle before ordering, i.e. if the part isn't suitable for his non-standard car, whose fault is it for not knowing/noticing?

    Did PV order the part against a registration number/chassis number and, if so, was the body kit fitted 'officially' and therefore recorded against the vehicle or is it an aftermarket kit that they would have no idea had been fitted.

    If the car was sourced from PV with the kit in place I'd expect more leverage than if your friend had walked in off the street and asked for a splitter for an M135i that he'd sourced elsewhere

    What does "supported him in purchasing... from BMW" mean?

    Does it mean he bought it from PV or did he buy it direct from BMW himself?  Who did he buy it from?

    If he bought it from PV then I would expect them to refund him as they obviously ordered the wrong bit of kit from BMW.  That's PV's responsibility.  I'm not surprised BMW won't refund - it isn't their problem

    But if he bought it from BMW himself, it depends how much input PV had in "supporting him".  Did PV identify the part he needed to order and told him that that was what he needed, or had you friend already identified what he thought was the correct part and PV simply assisted him in some way to buy the part that he had specified?

    It depends on who wrongly identified the part that was needed

    Today is March not February?

    As an in person purchase it will all come down to how the right part was identified. 

    Secondly, if he has discovered he has a body kit that wasn't put on by the factory then he'll also need to be informing their insurer of this.
