    My goodness those lawyers are clueless!

    We win almost every case here, and there is zero risk in defending a small claim.  You want them to sue you. That's how the scam ends.

    Instead of asking online lawyers, read the Second post if the NEWBIES thread.

    AND of course it's not too late to get together with the other affected and angry leaseholders and get the MA to throw out the parking firm.  That's why I showed you that link.

    Call a meeting. Start a WhatsApp group about the parking firm and get them removed.  I'm willing to bet there will be LOADS of people who are affected by PCNs and are angry like you.  Send everyone here.

    NO-ONE SHOULD PAY.

    I've done what you said and got the whatsapp group members from the block, and they are not happy.

    I'm going to write a letter to the MC and explain bringing in CPM was illegitimate, unless they can prove that 75% was approved. And have all the residents that support it, sign it.

    Should I complain directly to the Parking company?

    Nope I'd ignore them.

    Tell everyone NOT to pay and to all come here - defending a court claim costs and risks nothing.  No CCJ even if they lose (bet they didn't know that) because they'd just pay less than the claim and it then has no effect on credit rating.

    Refer the MC to the L & T Act as already advised. Tell everyone in your Whatsapp group to complain and make the same reference, advise them all to say they only showed permits as a curtesy, not to signify approval of the parking scheme, tell them all to opt out of said scheme and remove any implied right of access to their demised spaces (if applicable) and remove implied right of access to their vehicles (no right to attach NTDs).
    All should warn the MC that they are jointly and severally liable for the actions of their agents, so will be become joint defendants in any counterclaim should the PPC issue court claims against residents.

    This should all be done in writing as individual residents, not as a joint petition. A dozen complaints will have more effect than a dozen names on a single complaint.

    Everyone should also complain to their MP.  I have found this website very useful in the past.

    A bunch of complaints all about the same subject all arriving at the same time will hopefully jolt your MP into doing something.

    Noter that in the Landlord and Tenant Act there are two conditions that must be met for a change to a lease... 75% of all leaseholders must agree and no more than  10% of all leaseholders disagree. If either of those conditions are not met, there can be no change to the lease. Also, it is not just a simple "meeting". There has to be a recorded ballot. So, you need to demand evidence of any ballot if they try to fob you off with some story about a "meeting" where it was agreed to alter the lease and allow a third party to rent out your demised parking space for £100 a pop.
