If an accident isn't my fault, should I get back my excess?

As the title says.  If someone hits me and admits fault, should I be out my £700 excess?

    Your excess is an uninsured loss and needs to be recovered from the other party/their insurers. If you bought Legal Expenses cover your insurer should appoint someone to assist you doing this. If you didnt buy the cover then you will need to do it yourself. 

    Your insurers should be able to give you the details of the third party insurer. You will just need to send them a letter/email stating you are reclaiming your excess and enclose a copy of evidence that its been paid/deducted... dont send the original as post sometimes goes missing and it will be a headache to get a duplicate.
