Legal charges

I registered a claim with a company way back last year for diesel emissions. Then forgot all about it. Later that year (forgetting all about the earlier claim) I registered for the same thing with a different company. Now the first company has contacted me saying that thete is a duplicate claim for my vehicle, and legally only one claim can be made, and which company did I choose to go with. They said that there COULD be legal fees for cancelling one of the claims. I'm 75 years old, with a heart condition, and am panicking dreadfully that I could be charged legal fees. I phoned the company that I cancelled and was told that even though the forms had bren submitted to court, no decision had bern made, and it was unlikely that they would charge me, but I'm still frantic with worry.

I can't really offer any reassurance.  It will come down to the terms and conditions you signed up to.  What do they say?

And the obvious question:  What loss have you suffered that you wish to claim for?

Not sure the second question is particularly helpful in the scenario?

In principle you are going to have to discontinue the action with one of them, or both. No win, no fee is conditional that the claim proceeds unless they themselves decide there is no prospects of success.

You need to sit down and read what you signed with each of them. You can ask both of them what the cost of discontinuing would be at this point. You may get some goodwill if you explain your situation and own the mistake but clearly goodwill is just that and cannot be demanded.

A previous poster on here recently said they'd asked to withdraw their claim, they'd got bored of the process and didnt want to spend time digging out records etc. They received a bill for £350 from memory which was for setting up the file and reviewing the forms etc.

It isn't, but I'm curious.  I'd hope that people signing up for this sort of thing understand what they're signing up for, and why.   Of course vehicle manufacturers should be fined for falsifying emissions results, but how many people have actually suffered an identifiable and quantifiable loss, and how many are simply after a quick buck and aren't interested in the details?  I'm not inclined to help those in the latter category.

So got similar situation here. Submitted the claim years ago and forgot about it, looks like all email were going straight to spam for some reason. Then earlier this year i submited another one with different company. Then i got email from original company and new one that the case has been presented at court. Total panic. The thing is, second company run the de-duplication process twice and i did not flag up as signed with anyone else yet. As such, have i discovered some sort of loophole???? At this moment though, i am waiting for both of them to come back to me with cost as will need to cancell one claim. So just remeber, read what you sign and check you spam folder often.

And, more importantly, remember what you've signed up for.

Hello. Appreciate this is an old thread but I can’t find anything else on this. Did you ever receive a charge and if so, how much was it for? I’m in the same situation and feeling very annoyed with myself.

OP was last on the forum on March 8th 2024, you're not going to get an update.

Better to start a new post and describe your situation giving as much detail as you can.
