Moved into flat share and need to leave. How can I break the contract?

    Thanks. I don't fully understand the contract being honest. It began as a 2 year contract signed by 2 tenants who paid a share of the 2000pcm each (each person pays their share individually into the estate agents account). I have taken on the departing tenant's commitment and this runs until September (the end of the contract). 

    I'm going to be honest with the agent and say that it's just not a good fit and it'll make more sense for all parties if we replace me with someone more compatible with the house environment. I know it will incur a cost for me, but hopefully it won't be outrageous. 

    Your original post described your two flatmates - so there are 3 of you in the flat.
    Yet now you say "It began as a 2 year contract signed by 2 tenants" and " I have taken on the departing tenant's commitmen" implying one has left and there are now just the two of you. So
    * how many occupants are there?
    * Who are they eg A & B signed the original contract and you are C? Are A & B still there or has one left?
    * what have you signed? A contract naming you and A as 'The Tenant'? A contract naming you and A & B (or someone else) as 'The Tenant'?
    * Who is named on the contract you signed as 'The Landlord'?
    * Or have you never signed a contract? In which case who do you pay your rent to? A? B? the letting agent?


    Thanks. I've found the part of the contract that says I am able to leave the tenancy agreement if the landlord agrees to it. It says I will be responsible for covering any costs. So hopefully the landlord is understanding about this and then it will be up to me to cover any costs the estate agent pretend are incurred. 

    I think it's not really in the interests of the landlord/agent to have incompatible tenants so hopefully they won't make it a difficult process. 

    Not sure why " it's not really in the interests of the landlord/agent to have incompatible tenants " - the LL is unlikely to care provided the rent is being paid.
    As for being 'able to leave the tenancy', why would the LL agree and where would that leave the tenancy? Until you answer the Qs above about the tenancy type a lot of this is conjecture....

    I've already explained it as clearly as I can. There are 3 people in the flat including me. I replaced someone who bought their own place. We each pay a share of the overall flat rental price into the agency account each month.

    I've already explained it as clearly as I can. There are 3 people in the flat including me. I replaced someone who bought their own place. We each pay a share of the overall flat rental price into the agency account each month. 

    and you signed a contract with 3 tenants' names on it ? Yours and the other 2 remaining people yes?
    and the landlord is shown as...?

    By the sound of it you can only leave if either:
    1) the existing tenancy agreement is ended, which requires the agreement of not just the landlord but all 3 of the tenants as well or
    2) a Deed of Assignment is executed, substituting a new tenant in place of yourself on the existing tenancy agreement you signed - which also requires the consent of the other 2 tenants as well as the LL - see eample:

    In the interim, can you block her on Whatsapp and put a Do Not Disturb notice on your door?  Trivial but might work.

    Thank you for providing that link. I think a deed of assignment will be possible. There have been several tenant changes since the original move in date several years ago (only one original tenant remains). 

    I appreciate your advice.

    I have taken to ignoring the person in question. I think as someone said earlier in this thread, that's often the best method when someone keeps making trivial complaints. I think some people just do it because they are bored/want attention.
