Woodburner Flue Regulations

I have been going around in circles trying to get an answer to a question I have regarding the position of a neighbours woodburner flue.   Since they installed a woodburner, the smell of smoke has spoilt any enjoyment of being in the garden, and hanging out clothes is impossible.  The flue is located within 2.3m of my house, bordering onto the flat roof of my extension.  This extension is connected to the main house which has an apex roof.  Reading the regulations, it indicates that if a flue is within 2.3m of an adjacent building (within house boundary, or neighbouring property). the height of the flue must be 0.6m above the adjacent building.   What I cant figure out is if this means that it needs to be 0.6m above the ridge of my apex roof, or 0.6m above any surface in my property within 2.3m from the flue.   If its 0.6m above the ridge (which is more than 2.3m away) then the flue is too short.   If its within 2.3m of the flue, it extends to the flat roof of the extension only in which case it is over 0.6m above this surface.   Any help in clarifying this would be much appreciated.

    Sorry, I don't know. But if smoke and smell are causing a repeated 'nuisance', you can report this to your LA.
    Is the smoke visible? If so, take lots of photos. Do other folk comment on the smell? If so, record this.
    Keep a log of days & times, and add summaries of how bad, and what it prevents you from doing, and who else witnessed. 
    Perhaps email a local HETAS installer and ask that general Q re dims?
  • Not clear from your post but does the flue encroach across your boundary? Ie does it come out of a wall and over your extension.
    But if it is causing an actual smoke nuisance then reporting to the council could be an option. 
    We have a few near us and they can get quite annoying, have to close windows some nights etc. They are worse than bonfires. Should be banned imo! People burn all sorts of stuff in them too.

    Raising the flue may be an easy conversation (with a nice neighbour) or a battle. And yet it may not work either way

    We have 3 flues near us.  >6m up.  11m and 15m away.  And when the weather and windward/leeward building things conspire - we get a swirl and odour of woodsmoke at ground level on the leeward side of the building vs the prevailing winds.  Not visible smoke but that bonfire wood resin smell.    Other days and weather.  Would not know anyone had a fire if they ran it all day.   Interaction of speed, direction, temperature and the buildings.

    In case you persuade, or manage to force them to make it taller.  And it does not work to your satisfaction. 

    Fully legalised.  And falling well within the parameters of not being an actual statutory nuisance. i.e. *you* are done.  But still hate it.  And have upset the neighbour (more) with the BC game and the conveyancing notifiable neighbour dispute.   So subsequently you ask them to agree a no burn Friday washing day or two each week.  No chance. 

    Madder and inconsiderate stove owners collect scrap wood of all kinds and are a plague upon the land ignorantly burning treated timber.  Nasty chemicals.  Terrible smells.  That really is an environmental health matter and a statutory nuisance.  

    If this is just bought in seasoned logs you are truly in the shallow end of potential stove nuisance already.

    If it sticks, force it.
    If it breaks, well it wasn't working right anyway.
