Refund

Please can anyone help, I’ve tried everything. I booked and paid a deposit for a restaurant as a Christmas gift. I booked and paid in November 2023 and the revelation was for Jan 2024. The week leading up to Xmas the restaurant announced they were closing for good at the end of the week. Between Xmas & new year I received an email from them to say that they would be issuing my refund for the deposit I paid and it would be in my account within 10 days. I’ve had nothing. All the contact details they gave me in case I had any issues/questions are no longer in use, phones are cut off, emails just bounce. I’ve sent letters, used social media etc etc but nothing. I’m really stuck. I’ve contacted citizens advice who said there is nothing they can help with, the company is still registered.

You could look at a chargeback on your debit card via your bank although that will depend if their account is still open/has money in it.
If the company is still registered there is always the small claims option but again if they don't have the money to give you then you could end up more out of pocket.
For future reference, put anything over £100 on a credit card as that gives you more protection if things do go wrong.

if the company is still registered but not trading or insolvent than you are unlikely to get anything back
if they are solvent and still trading then the small claims court is your best bet
however before you do that I would try your card as recommended above

Any funds come from their merchant bank. How they get it back is their problem...elsien said:You could look at a chargeback on your debit card via your bank although that will depend if their account is still open/has money in it.

The merchant bank can not decline as retailer has no funds.
