DCB Legal and Cort Letters help

I got my first DCB legal letter dated 18 January 2024 for a claim happened on 12 February 2023

The letter states that my "Vehicle Remained On Private Property In Breach Of The Prominently Displayed Terms And Conditions" at "Airport Retail Park CV3 4RP Coventry". It said that I have to pay £155 within 28 Days. - I did ignored the letter :/ becouse I never recived an Initial letter!

I recived secound letter "Claim Form" form Civil National Business Centre dated 22 February 2024 and the total amount went up to £250.32 - I have 14 Days to respond to that one, so today 16 March 2024 ..

I remembered what we did that day at Airport Retail ParkI. I have 2 year old that was 1 when we visited the shopping centar with my wife and her parents for shopping and eating. I rang DCB Legal to figure out how long I overstayed because with my kid we shouldn't stay longer then 2-3 hours.

So the maximum stay over there is 3 Hours and I overstay 13 Minutes. I asked the lady on the phone is there no grace period and she said is 10 minutes. So I overstayed 3 minutes and have to pay £250.32. I did mentioned to her that i never received initial PCN from them and I was not aware of the fine until last month, and becouse of that I never had the opportunity to pay the £50 pound charge within 14 days. I told the lady on the phone that I am not paying right now and I will dispute the fine. 

For me and my family £250 is a lot for a fine for 13 minutes overstay especially with 1 year old kid that requires feeding and nappy change.

I read a lot in the forum here and decided to message and seek help with my defence.

Please if someone can advice me how to handle the situation?

    Hello and welcome.

    It sounds like you may have a County Court Claim Form you are wanting help with.
    If that's so, what is the Issue Date on it?

    You say a second Claim Form. How many Claim Forms do you have?

    Who is the Claimant?

    Can you please show us the Particulars of Claim. Take a picture and hide all identifying detail before posting here.

    I have two letters in total one from DCB Legal dated 18/01/2024. And one from cort dated 22/02/2024

    If the "issue date" on your claim form is 22nd February, you have until 12th March to acknowledge service (AoS). There is nothing to be gained by delaying the AoS. When you have done the AoS in a timely manner, you would have until 4pm on Tuesday 26th March to file your defence.

    You need to go back and re-read the Newbies/FAQ thread. Why are you even talking to DCB Legal? They did not issue the PCN. They are just the firm of shysters solicitors representing the claimant.

    Is the address on your V5C logbook correct and up to date? Whenever you last moved, besides updating your drivers licence, did you update the V5C? Please go and check now. That is usually the reason why the first news you get about a PCN is when you get an LoC or a claim.

    Thank you fro the update on the dates, that put some sort of relief that I have some more time. I will send the AoS today or tomorrow. 

    About the V5C we moved house January 2023 just before the shopping center visit. And my V5C logbook is still under the old address. My driving license is updated. 

    I will visit the FAQ thread later today. I am with the little one right now.

    So I just checked my V5C logbook and apparently I did change it and it's dated 20/03/2023 so 36 Days after the visit of the shopping center.

    Point 3 in those Particulars are pretty vague aren't they?...



    They give no clues to what the driver may have done wrong.

    You would be wise to include the extra CEL v Chan paragraphs in your Defence and watch the case get thrown out without a hearing... hopefully.

    Didn't receive all letters from PPC please consider supporting this.

    So many people don't receive 1st and/or 2nd pcn but the £170 payment due letter often manages to drop through letter boxes. PPCs always claim discounted/full rate pcns/court claim letters were sent as dated though they offer no evidence to prove this.

    Since they CHOOSE NOT to provide evidence of their posting we must continue to press gov to ensure they do and see it included in the new Parking CoP. Please sign/share @jmccabe petition closes 22nd june 2024.
