LETTER OF CLAIM

A PCN was received for over staying 29mins from UKPC was ignored along with debt collector letters. Driver then received a 'Letter of Claim' from UKPC dated 6/2/24, then received another 'Letter of claim' from DCBLegal" dated 19/02/24. After seeking some advice a week later driver decided to pay save the hassle, after entering details came up "This claim has been discontinued. There is no outstanding balance." Does this mean the alleged offence has been written off? Thank you.

    Yes it is cancelled.

    They were actually going to pay the extortionate £170 (to make it go away) to avoid paying nothing in the end?  Which mad advice made them think that was a good option?

    Don't tell us, they asked the clueless CAB who are oblivious to private parking cases, scare and mislead people (not deliberately I'm sure) and don't know that DCB Legal discontinue cases?  They have even been known to make people think they'd be risking a CCJ just by defending a court claim; totally wrong advice.

    This would haver have reached a court hearing.  No CCJ would be risked by defending a case.  You never have to pay.  Not as it stands, unless a Judge says so.

    The industry has blocked Government regulation, so by their own choice they remain what most right-thinking people call a cowboy industry.

    Certainly NEVER pay £170.  Make sure the driver knows this if they get another LBC.

    Now a claim form has been received proceeding to go court for a total of £264.44! Keeper is confused with it stating the claim was discontinued when previously trying to pay?? Any help? Advice?

    Does it have the same court reference number as the discontinued case?  Is there perhaps another PCN in play?

    Based on the OP's first post on 4th March, I would doubt that any court claim had been issued previously as the Letter of claim is said to be 19/02/24.

    Easy to defend; there will be no court hearing as UKPC aren't likely to do those.

    What is the Issue Date on your Claim Form?

    Have you filed an Acknowledgment of Service?
    If so, upon what date did you do so?
    Your MCOL Claim History will have the definitive answer to that.

    The claim that the OP tried to pay was actually "discontinued" according to that screenshot. I too wonder if there is more than one PCN in play here.

    There were x2 PCNs received first was paid at discount price, second PCN was appealed but no reply was received. The usual threat letters to pay received, ignored. A letter of claim from UKPC was issued on 06/02/2024. Then a Letter of claim was issued from DCBLegal on the 19/02/2024. A week or so later is when it was attempted to pay but repeatedly came up with claim.was discontinued/no outstanding balance. Then 22/03/2024 a claim form was issued from the county court. Reference match on claim form & dcblegal letter of claim. Acknowledgement of claim & AOS submitted.
